                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Provides that person providing cellular telephone service may
not disclose location of cellular telephone or disclose records
relating to location of cellular telephone.
  Provides that person providing cellular telephone service may
not send advertising to customer's cellular telephone based on
location of telephone unless customer has given prior written
consent.
 
                        A BILL FOR AN ACT
Relating to cellular telephones.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 and 3 of this 2001 Act are added to
and made a part of ORS chapter 759. + }
  SECTION 2.  { + (1) Except as provided in this section, a
person providing cellular telephone service may not:
  (a) Disclose the location of a cellular telephone to any other
person; or
  (b) Disclose any records maintained by the service relating to
the location of a cellular telephone during any period of time.
  (2) The provisions of this section do not apply to the release
of information about the location of a cellular telephone for the
purpose of establishing roaming charges or other communications
between mobile telephone switching offices.
  (3) The provisions of this section do not apply to release of
any information:
  (a) For the purposes of responding to 9-1-1 calls;
  (b) Pursuant to a court order; or
  (c) To the Oregon State Police, a county sheriff's department
or municipal police department in circumstances in which the
release of information is necessary to prevent death or serious
injury to any person. + }
  SECTION 3.  { + A person providing cellular telephone service
may not send advertising to a customer's cellular telephone based
on the location of the telephone unless the customer has given
prior written consent to receiving such advertising. + }
