SUMMARY

Creates Task Force on Domestic Violence Against Immigrant and
Migrant Women in Oregon. Requires Department of Justice to
provide staff and funds.
Sunsets January 1, 2004.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to domestic violence; appropriating money; and declaring
an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) There is created the Task Force on Domestic
Violence Against Immigrant and Migrant Women in Oregon consisting
of 12 members. The members shall be appointed on or before
October 1, 2001, as follows:
(a) The Speaker of the House of Representatives shall appoint
three members;
(b) The President of the Senate shall appoint three members;
(c) The Governor shall appoint four members; and
(d) The Attorney General shall appoint two members.
(2) The task force shall:
(a) Study and issue a report on the following issues relating
to immigrant women and migrant women in Oregon:
(A) The extent of domestic violence against these women;
(B) The unique issues that confront these women;
(C) The services available to these women, including victims'
assistance;
(D) The information on domestic violence that is available and
the manner in which the information is conveyed to these women;
and
(E) The manner in which the State of Oregon works with the
United States Immigration and Naturalization Service.
(b) Make recommendations to improve assistance provided by the
State of Oregon to immigrant women and migrant women in this
state.
(3) The task force is subject to the provisions of ORS 171.605
to 171.635 and has the authority contained in ORS 171.505 and
171.510. The task force shall report to the appropriate
committees of the Senate and the House of Representatives of the
Seventy-second Legislative Assembly not later than March 1, 2003.
(4) The Department of Justice shall provide staff necessary to
the performance of the functions of the task force.
(5) Members of the task force are entitled to compensation and
expenses under ORS 292.495. Claims for expenses incurred in
performing functions of the task force shall be paid out of funds
available for that purpose.
(6) All agencies, departments and officers of this state are
directed to assist the task force in the performance of its
functions, and to furnish such information and advice as the
members of the task force consider necessary to perform their
functions.
(7) Official action by the task force established under this
2001 Act shall require the approval of a majority of the members.
All legislation recommended by official action of the task force
must indicate that it is introduced at the request of the task
force. Such legislation shall be prepared in time for presession
filing under ORS 171.130, for presentation to the regular session
of the Seventy-second Legislative Assembly. + }
SECTION 2. { + The Department of Justice shall provide $___ to
the Task Force on Domestic Violence Against Immigrant and Migrant
Women in Oregon for the purposes of section 1 of this 2001 Act
from moneys appropriated to the department by the Legislative
Assembly for the biennium beginning July 1, 2001. + }
SECTION 3. { + The Department of Justice may accept
contributions of funds from the United States, its agencies or
from any other source, public or private, and agree to conditions
thereon not inconsistent with the purposes of the task force. + }
SECTION 4. { + All moneys received by the Department of
Justice under section 3 of this 2001 Act shall be paid into the
State Treasury and deposited in the General Fund to the credit of
the Department of Justice. The moneys are appropriated
continuously to the Department of Justice for the purposes of
section 1 of this 2001 Act. + }
SECTION 5. { + Sections 1 to 4 of this 2001 Act are repealed
January 1, 2004. + }
SECTION 6. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
