SUMMARY

Proclaims certain unincorporated territory in Multnomah County
to be annexed to City of Portland without further action or voter
approval. Requires City of Portland to comply with certain
consistent provisions of annexation procedures.
A BILL FOR AN ACT
Relating to annexation of Dunthorpe.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Legislative Assembly proclaims that the
boundaries of the City of Portland are extended by the annexation
of unincorporated territory in Multnomah County known as
Dunthorpe, containing blocks 90 to 141 inclusive, and beginning
from an iron pipe at the corner of section 34 and 35, township 1
south, range 1 east, Willamette Meridian and sections 2 and 3,
township 2 south, range 1 east, Willamette Meridian; thence
southerly 89o37'16'' east along the southern boundary of section
35, township 1 south, range 1 east, Willamette Meridian 1641.24
feet to the center of the county road from Portland to Oswego;
thence northerly along the center line of said county road north
22o11'30'' 853.64 feet; thence north 8o9'30'' 255.90 feet; thence
northerly 12o48'30'' to an iron pipe on the north line of the
Socrates H. Tryon D.L.C. and the center line of Tuttle Avenue in
Abernathy Heights; thence southerly 89o38'27'' west along north
line of Socrates H. Tryon D.L.C. and the south line of Abernathy
Heights and Palatine Hill 4477.37 feet to an iron pipe 20 feet
westerly from the center line of Sylvan Avenue in Palatine Hill;
thence southerly 133.18 feet; thence on a curve to the left
having a radius of 420 feet and a central angle of 19o30' and
tangent to the last mentioned course, 142.94 feet; thence a curve
to the left having a radius of 240 feet and a central angle of
70o30' and tangent to the last mentioned curve, 295.31 feet;
thence easterly 366.08 feet; thence on a curve to the right
having a radius of 245 feet and a central angle of 44o59' and
tangent to the last mentioned course, 192.35 feet; thence on a
curve to the right having a radius of 215 feet and a central
angle of 71o8'15 '' and tangent to the last mentioned curve,
266.94 feet; thence on a curve to the left having a radius of
97.27 feet and a central angle of 74o47'16'' and tangent to the
last mentioned curve, 126.98 feet; thence on a curve to the left
having a radius of 3,030 feet and a central angle of 7o7'59'' and
tangent to the last mentioned curve, 377.22 feet; thence on a
curve to the right having a radius of 1,470 feet and a central
angle of 22o56' and tangent to the last mentioned curve, 588.38
feet; thence on a curve to the left having a radius 1,530 feet
and a central angle of 0o2'25'' and tangent to the last mentioned
curve 1.08 feet to a point on the southern boundary of section
34, township 1 south, range 1 east, Willamette Meridian, thence
south 89o24'22'' east along the south boundary to section 34,
797.25 feet to the beginning; excepting only the following
described tract: Beginning at a point on the center line of the
county road from Portland to Oswego south 22o11'30'' west, 200
feet from the northwest corner of Lot 12 in Elk Rock Villas, in
section 35, township 1 south, range 1 east, Willamette Meridian;
thence southerly 22o11'30'' west along the center line of the
county road from Portland to Oswego, 100 feet; thence at a right
angle to said county road northerly 67o48'30'' west 130 feet;
thence northerly 22o11'30'' east parallel to said county road,
100 feet; thence southerly 67o48 ' 30'' east 130 feet to the
place of beginning.
(2) Notwithstanding contrary provisions contained in ORS
chapter 222 or the charter and ordinances of the City of
Portland, the annexation described in subsection (1) of this
section is effective without further action and without a
requirement that electors approve the annexation.
(3)(a) The provisions of ORS chapter 222 apply to the
annexation of unincorporated territory declared in subsection (1)
of this section to the extent not otherwise inconsistent with the
requirements of this section.
(b) For the purposes of notices, reports and filings required
by ORS 222.005, 222.010, 222.030 and 222.177, a copy of this
section shall substitute for a copy of the ordinance or
resolution proclaiming the annexation.
(4) The annexation of unincorporated territory into the city
limits of Portland by subsection (1) of this section is effective
on and after the effective date of this 2001 Act. The territory
annexed shall be included within the corporate limits of the City
of Portland and treated consistently with unincorporated
territory annexed by the procedures enacted under ORS chapter
222. + }
