SUMMARY

brief statement of the essential features of the measure as
introduced.
Requires fishing derby organizer intending to use guide
registered in state other than Oregon to register derby with
State Marine Board. Requires State Marine Board to issue permit
for derby and to issue temporary guide registration for each
guide registered in state other than Oregon.
Punishes violation of section by revocation of permit and
denial of future permit for one year from date of violation.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to fishing derbies; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 704. + }
SECTION 2. { + (1) For the purposes of this section, 'fishing
derby' or 'derby' means a multiday angling event held in Oregon
as a fund-raiser.
(2) An organizer of a fishing derby shall register the time and
location of the derby with the State Marine Board if the
organizer intends to use a guide registered or licensed in a
state other than Oregon. Each derby registration shall be
accompanied by a fee of $50.
(3) Upon registration under subsection (2) of this section, the
State Marine Board shall issue a derby permit to the derby
organizer. The board shall also issue a temporary Oregon
outfitter and guide registration for each guide used in a fishing
derby who is registered or licensed in a state other than Oregon.
The temporary registration may not be valid for more than three
days and shall display the dates of validity on the face of the
registration. The temporary registration shall be issued upon a
showing by the derby organizer that each guide:
(a) Is a resident of a state other than Oregon; and
(b) Is a holder of a valid outfitter or guide registration or
license from a state other than Oregon.
(4) Each guide who holds the temporary registration issued
under subsection (3) of this section shall carry the temporary
registration at all times during the fishing derby.
(5) A violation of any provision of this section shall result
in the revocation of the current derby permit issued under
subsection (3) of this section and the denial of a future derby
permit for one year from the date of violation. + }
SECTION 3. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
