SUMMARY

Requires City of Portland to eliminate untreated combined sewer
overflow discharge into Columbia Slough and Willamette River on
certain time schedule.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to combined sewer overflow; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 468B. + }
SECTION 2. { + (1) As used in this section, 'combined sewer
overflow' means a bypass pipe through which excess combined
sanitary sewage and storm water runoff are discharged directly to
the waters of this state.
(2) Notwithstanding any other provision of chapter 468B and in
accordance with the schedule set forth in subsection (3) of this
section, the City of Portland shall eliminate all untreated
combined sewer overflow discharges to:
(a) The Columbia Slough:
(A) From November 1 through April 30 except during storms
greater than or equal to a storm with a five-year return
frequency; and
(B) From May 1 through October 31 except during storms greater
than or equal to a storm with a 10-year return frequency.
(b) The Willamette River:
(A) From November 1 through April 30 except during storms
greater than or equal to a storm with a four-in-one-year return
frequency; and
(B) From May 1 through October 31 except during storms greater
than or equal to a storm with a three-year return frequency.
(3) The City of Portland shall complete the requirements of
subsection (2) of this section in accordance with the following
schedule:
(a) On or before December 1, 2002, eliminate all untreated
combined sewer overflow discharges into the Columbia Slough,
subject to the storm return frequencies set forth in subsection
(2) of this section.
(b) On or before December 1, 2003:
(A) Subject to the storm return frequencies set forth in
subsection (2) of this section, eliminate untreated combined
sewer overflow discharges at 20 combined sewer overflow
discharger points, including discharges to the Columbia Slough,
consistent with a facilities plan approved by the Environmental
Quality Commission; and
(B) Submit final engineering plans and specifications for
construction work required to comply with paragraph (d)(A) of
this subsection.
(c) On or before May 1, 2005, begin construction required to
comply with paragraph (d)(A) of this subsection.
(d) On or before December 1, 2008:
(A) Eliminate untreated combined sewer overflow discharges,
subject to the storm return frequencies set forth in subsection
(2) of this section, at 16 of the remaining combined sewer
overflow discharge points, in accordance with the facilities plan
approved by the Environmental Quality Commission; and
(B) Submit engineering plans and specifications for
construction work required to comply with paragraph (f) of this
subsection.
(e) On or before May 1, 2010, begin construction required to
comply with paragraph (f) of this subsection.
(f) On or before December 1, 2013, eliminate untreated combined
sewer overflow discharges, subject to the storm return
frequencies set forth in subsection (2) of this section, at all
remaining combined sewer overflow discharge points, consistent
with the facilities plan approved by the Environmental Quality
Commission.
(4) On or before September 1 of each year until 2014, the City
of Portland shall submit to the Department of Environmental
Quality, the Environmental Quality Commission and the Legislative
Assembly for review an annual progress report on efforts to
eliminate untreated combined sewer overflow discharges, subject
to the storm return frequencies set forth in subsection (2) of
this section. The annual report shall include, at a minimum, the
work completed in the previous fiscal year and work scheduled to
be completed in the current fiscal year. + }
SECTION 3. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
