SUMMARY

brief statement of the essential features of the measure as
introduced.
Creates position of Consul General within Department of Land
Conservation and Development. Directs Consul General to evaluate
record of matters that Land Conservation and Development
Commission or Director of Department of Land Conservation and
Development could appeal and determine whether commission or
director should appeal.
Appropriates moneys to department for position of Consul
General.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to review of land use decisions; appropriating money;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 197. + }
SECTION 2. { + (1) There is created within the Department of
Land Conservation and Development the position of Consul General
to be appointed by the Governor.
(2) The Consul General shall:
(a) Evaluate the record for procedural or substantive errors by
the Land Conservation and Development Commission or the
Department of Land Conservation and Development prior to action
by the commission or the Director of the Department of Land
Conservation and Development to seek review of a land use
decision, expedited land use decision or limited land use
decision involving the goals, acknowledged comprehensive plan or
land use regulations or other matters within the statutory
authority of the commission or the department; and
(b) If the Consul General finds procedural or substantive
errors or any other basis for concluding that further review is
not merited, direct the commission or the director to refrain
from seeking further review of the matter.
(3) The department shall provide staff and office space
necessary for the work of the Consul General. + }
SECTION 3. { + There is appropriated to the Department of Land
Conservation and Development, for the biennium beginning July 1,
2001, out of the General Fund, the amount of $___ for the purpose
of carrying out section 2 of this 2001 Act. + }
SECTION 4. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
