  On page 1 of the printed A-engrossed bill, delete lines 12
through 15 and insert:
  ' (b) Upon petition of a person, the department shall
investigate and may hold a hearing and, following a hearing, may
enter an order fixing and regulating the length of time a public
railroad-highway grade crossing may be blocked by railroad
equipment.'.
  In line 19, restore '$100' and delete '$500' and restore '
$3,000' and delete '$5,000'.
  In line 21, delete 'Sections 3 and 4 of this 2001 Act are ' and
insert 'Section 3 of this 2001 Act is'.
  On page 2, delete lines 2 through 14.
  In line 15, delete '4' and insert '3'.
  Delete lines 17 through 21 and insert:
  ' (2)(a) Upon petition of the public authority in interest, or
of any railroad or upon the Department of Transportation's own
motion, the department shall, after due investigation and
hearing, unless hearing is not required under ORS 824.214, enter
an order establishing a safe distance from a public
railroad-highway grade crossing at which a railroad may stop or
park equipment.
  ' (b) Upon petition of a person, the department shall

enter an order establishing a safe distance from a public
railroad-highway grade crossing at which a railroad may stop or
park equipment.'.
  In line 22, delete '(b)' and insert '(3)' and delete '

  In line 23, delete 'section'.
  In line 25, delete '(3)' and insert '(4)'.
  In line 26, delete '$500' and insert '$100' and delete '
$5,000' and insert '$3,000'.
  In line 27, delete '5' and insert '4'.
  In line 31, delete 'sections 3 and 4' and insert 'section 3'.
  In line 36, delete '6' and insert '5'.
  On page 3, line 21, delete '5' and insert '4'.
