Requires State Lottery Commission to phase out video lottery
games by January 1, 2012. Establishes timetable for phase-out of
operation of video lottery terminals by video lottery retailers.
Authorizes commission to allow exceptions.
Takes effect on effective date of constitutional amendment
proposed by House Joint Resolution 55 (2001).
A BILL FOR AN ACT
Relating to phase-out of video lottery games; and prescribing an
effective date.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Oregon State Lottery may not operate any
video lottery games. + }
SECTION 2. { + Section 1 of this 2001 Act becomes operative on
January 1, 2012. + }
SECTION 3. { + (1) Notwithstanding any other provision of law,
video lottery retailers may not operate:
(a) More than four video lottery terminals after January 1,
2004.
(b) More than three video lottery terminals after January 1,
2006.
(c) More than two video lottery terminals after January 1,
2008.
(d) More than one video lottery terminal after January 1, 2010.
(2) Notwithstanding subsection (1) of this section, the State
Lottery Commission may adopt rules to allow video lottery
retailers to operate more video terminals than permitted by
subsection (1) of this section if the video lottery retailer can
demonstrate to the satisfaction of the commission that adherence
to the requirements of that subsection would create a financial
hardship on the video lottery retailer. The commission may not
authorize the operation of more than five video lottery terminals
at one location or the operation of any video lottery terminals
after January 1, 2003. + }
SECTION 4. { + This 2001 Act does not take effect unless the
amendment to the Oregon Constitution proposed by House Joint
Resolution 55 (2001) is approved by the people at the next
regular election held throughout this state. This 2001 Act takes
effect on the effective date of that constitutional
amendment. + }
