                             SUMMARY

  Authorizes state or public officer to broadcast public notice
in certain broadcast markets. Prescribes criteria and parameters
for broadcasts.
 
                        A BILL FOR AN ACT
Relating to broadcast of public notices.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + As used in sections 2 to 4 of this 2001 Act,
unless the context requires otherwise:
  (1) 'Broadcast' means the transmission of information by means
of radio or television facilities or cable systems.
  (2) 'Station' means:
  (a) A radio or television station licensed for commercial
operation by the Federal Communications Commission.
  (b) A cable television system. + }
  SECTION 2.  { + (1) If a state or other public officer
determines that broadcasting a notice over a station is a
reasonable, effective and efficient method of providing notice,
the officer may broadcast the notice over a station in the Bend,
Eugene, Klamath Falls or Portland broadcast markets, at the times
and frequencies the officer considers to be reasonable, effective
and efficient.
  (2) When determining whether to broadcast a notice over a
station, the officer may consider:
  (a) In the case of a radio or television facility, the
facility's signal strength, coverage and audience.
  (b) In the case of a cable system, the system's number of
subscribers and the community the cable system reaches.
  (c) The length of the text of the notice. + }
  SECTION 3.  { + (1) A station that broadcasts a notice pursuant
to section 2 of this 2001 Act must broadcast the notice between 6
a.m. and 10 p.m.
  (2) A station may not charge a fee to broadcast a notice that
exceeds the fee the station charges to local advertisers for a
like period and class of commercial time. + }
  SECTION 4.  { + Proof of publication of a notice broadcast
under section 2 of this 2001 Act shall be by affidavit of the
owner, manager, assistant manager or program director of the
station, in substantially the following form: + }
