                      SENATE AMENDMENTS TO

  On page 1 of the printed A-engrossed bill, delete lines 12
through 16 and insert:
  ' (2)(a) The Department of Transportation, the Oregon
Department of Administrative Services or any other state public
contracting agency shall adopt rules establishing a two-tiered
selection process for when the department or agency executes
contracts with engineers, architects and land surveyors to
perform personal service contracts. This process shall apply only
if:'.
  In line 19, after the first 'state' insert 'public
contracting'.
  In line 20, after 'contracts' insert 'with engineers,
architects and land surveyors' and after 'improvement' insert '
project'.
  On page 2, after line 5, insert:
  ' (d) Nothing in this subsection applies to the selection
process used by a local public contracting agency when the agency
executes a contract directly with engineers, architects or land
surveyors.'.
  In line 21, delete 'public contracting' and after ' contracts'
insert 'executed'.
  On page 3, line 9, after '(3)' insert 'or (4)'.
  After line 27, insert:
  ' (4) If the screening and selection procedures created by a
public agency under subsection (3) of this section result in the
determination by the public agency that two or more candidates
are equally qualified, the public agency may select a candidate
through any process adopted by the public agency.'.
  In line 28, delete '(4)' and insert '(5)'.
  In line 37, delete '(5)' and insert '(6)'.
  In line 43, delete '(6)' and insert '(7)'.
  On page 4, line 4, delete '(7)' and insert '(8)'.
  After line 6, insert:
  '  { +  SECTION 4. + }  { + Section 5 of this 2001 Act is added
to and made a part of ORS 279.011 to 279.063. + }
  '  { +  SECTION 5. + }  { + (1) As used in this section,
'consultant' means a registered professional engineer, registered
architect or registered professional land surveyor.
  ' (2) An agency of any political subdivision of this state may
enter into a personal service contract directly with a consultant
if the project described in the personal service contract
consists of work that has been substantially described, planned
or otherwise previously studied or rendered in an earlier
contract with the consultant that was awarded pursuant to rules
adopted under ORS 279.049 and the new contract is a continuation
of that project.
  ' (3) A political subdivision may adopt criteria for
determining when this section shall apply to a personal service
contract. + } ' .
 
  In line 7, delete '4' and insert '6' and before 'The ' insert
'Section 5 of this 2001 Act and'.
