Prohibits application of pesticides to school site except for
specified purposes.
A BILL FOR AN ACT
Relating to pesticides.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section:
(a) 'Pesticide' has the meaning given that term in ORS 634.006;
and
(b) 'School site' means a public or private facility used for
education in kindergarten, grades 1 through 12 or any part
thereof. + } { + 'School site' includes the buildings or
structures, playgrounds, athletic fields, school vehicles and
other areas of school property routinely visited or used by
pupils.
(2) A person may not apply a pesticide to a school site unless
the pesticide application is for the purpose of preventing or
eradicating insects, nematodes, weeds or fungi that are injurious
to persons or animals, may cause physical damage to buildings,
equipment, sidewalks, athletic fields or other property, or may
damage agricultural crops or produce.
(3) The State Department of Agriculture may impose a civil
penalty on a person who violates subsection (2) of this section.
The amount of the civil penalty may not exceed $1,000 for a first
violation or $2,000 for a second or subsequent violation. + }
