                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Requires Department of Transportation to develop program that
encourages use of traction tires over studded tires. Requires
tire dealers to offer certain discounts for exchange of studded
tires and purchase of traction tires. Requires department to
reimburse tire dealers for discounts. Requires tire dealers to
charge surcharge for purchase of studded tires and to submit
surcharge to department. Continuously appropriates moneys
received from surcharge for reimbursement of discounts.
 
                        A BILL FOR AN ACT
Relating to studded tires; and appropriating money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) For the purposes of this section:
  (a) 'Studded tires' means tires with studs that are described
in ORS 815.165.
  (b) 'Traction tires' does not include tires with studs that are
described in ORS 815.165.
  (2) The Department of Transportation shall develop a program
that encourages the use of traction tires over studded tires.
  (3) In developing the program, the department shall:
  (a) Identify traction tires manufactured specifically for
adverse weather conditions;
  (b) Design a form that tire dealers will submit to the
department for reimbursement of the discounts offered in
subsection (4) of this section. The form shall include the
customer's name, address, the vehicle identification number of
the vehicle for which the traction tires are purchased and the
date of the sale; and
  (c) Develop an accounting system to track the number of
traction tires sold and the number of studded tires exchanged.
  (4) The program shall require tire dealers to:
  (a) Issue a $20 discount for each studded tire a customer
exchanges for a traction tire identified under subsection (3) of
this section.
  (b) Issue a $10 discount for each traction tire a customer
purchases without exchanging a studded tire.
  (c) Add a $10 surcharge to the purchase of each studded tire.
The surcharge shall be remitted to the department.
  (d) Submit the form developed under subsection (3) of this
section to the department.
 
  (5) Upon receipt of the form submitted under subsection (4) of
this section, the department shall reimburse the tire dealer for
any discounts issued. + }
  SECTION 2.  { + Moneys received by the Department of
Transportation from the surcharge imposed on studded tire
purchases under section 1 (4) of this 2001 Act are continuously
appropriated to the department for the purpose of funding the
discounts required by section 1 (4) of this 2001 Act. + }
