Prohibits attorney who represents governing body of public body
from representing public body in judicial or quasi-judicial
proceeding if any member of governing body is party to proceeding
and has adverse interests.
A BILL FOR AN ACT
Relating to attorneys for public bodies.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section, 'governing body '
and 'public body' have the meanings given those terms in ORS
192.610.
(2) An attorney who represents the governing body of a public
body may not represent the public body in any judicial or
quasi-judicial proceeding if:
(a) Any member of the governing body is a party to the
proceeding; and
(b) The member of the governing body who is a party to the
proceeding has interests in the proceeding that are adverse to
the interests of the public body.
(3) The provisions of this section do not apply to the Attorney
General or to any attorney employed by the Attorney General. + }
