                             SUMMARY
 
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Provides that Director of Oregon Department of Administrative
Services administer revenue replacement program for interagency
drug enforcement task forces that experience reductions in
funding attributable to limitations on use of civil forfeiture
proceeds under section 10, Article XV of Oregon Constitution.
Specifies manner in which moneys are to be distributed.
  Appropriates moneys from General Fund to Oregon Department of
Administrative Services for implementation of revenue replacement
program.
 
                        A BILL FOR AN ACT
Relating to law enforcement; and appropriating money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Director of the Oregon Department of
Administrative Services shall administer a revenue replacement
program for interagency drug enforcement task forces that have
reductions in funding attributable to the limitations on the use
of civil forfeiture proceeds under section 10, Article XV of the
Oregon Constitution. During each biennium, the revenue
replacement program shall distribute such funds to interagency
drug enforcement task forces as may be appropriated to the Oregon
Department of Administrative Services by the Legislative Assembly
for the purpose of implementing the program. Funds from the
revenue replacement program may be distributed only to
interagency drug enforcement task forces that were in operation
on January 1, 2001.
  (2) The director shall distribute the funds available under the
revenue replacement program for each calendar year based on a
percentage calculated for each interagency drug enforcement task
force that was in operation on January 1, 2001. The percentage
for each interagency drug enforcement task force shall be
calculated as follows:
  (a) The director shall determine the average annual forfeiture
revenue attributable to calendar years 1999 and 2000 for each
interagency drug enforcement task force. The average annual
forfeiture revenue shall be calculated based on the revenues
reported to the Asset Forfeiture Oversight Advisory Committee
under the provisions of ORS 475A.120 and 475A.125.
  (b) The average annual forfeiture revenue determined under
paragraph (a) of this subsection shall be divided by the average
annual revenues from all forfeitures reported by interagency drug
enforcement task forces that were attributable to calendar years
1999 and 2000, as reported to the Asset Forfeiture Oversight
Advisory Committee under the provisions of ORS 475A.120 and
475A.125.
  (c) If any interagency drug enforcement task force in operation
on January 1, 2001, ceases operations at any time after January
1, 2001, the share attributable to that task force under the
provisions of this subsection shall be distributed to all
remaining interagency drug enforcement task forces receiving
funding under this section in proportion to their shares in the
annual distribution.
  (3) The director may not make a distribution of funds to an
interagency drug enforcement task force under this section that
is greater than the amount contributed in cash, services or
property by all local law enforcement agencies participating in
the task force. If any amounts are not distributed to an
interagency drug enforcement task force by reason of the
provisions of this subsection, the amounts shall be distributed
to all remaining task forces receiving funding under this section
in proportion to their shares in the annual distribution.
  (4) Notwithstanding subsections (2) and (3) of this section,
the director shall distribute each year to each interagency drug
enforcement task force from the revenue replacement program
established under this section an amount of not less than
$___. The amounts payable to interagency drug enforcement task
forces that are not subject to this subsection shall be reduced
in proportion to their shares in the annual distribution to the
extent necessary to meet the requirements of this subsection.
  (5) Each interagency drug enforcement task force receiving
funds under the provisions of this section shall provide to the
director all information requested by the director that is
necessary for the implementation of this section. + }
  SECTION 2.  { + The Director of the Oregon Department of
Administrative Services shall report to the Seventy-second
Legislative Assembly on the implementation of section 1 of this
2001 Act and on all distributions made to interagency drug
enforcement task forces under the provisions of section 1 of this
2001 Act. + }
  SECTION 3.  { + There is appropriated to the Oregon Department
of Administrative Services for the biennium beginning July 1,
2001, out of the General Fund, the amount of $___ for the purpose
of carrying out the provisions of section 1 of this 2001 Act and
for paying the administrative expenses of the department in
carrying out the provisions of section 1 of this 2001 Act. + }
