                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Provides that territory annexed to city in special district
after annexation of city to district is included in district
boundaries. Removes territory from special district that
previously serviced territory if certain conditions apply.
 
                        A BILL FOR AN ACT
Relating to annexation by special districts; amending ORS
  198.867.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 198.867 is amended to read:
  198.867. (1) If the electors of the city approve the
annexation, the city governing body shall:
  (a) Certify to the county board of the principal county for the
district the fact of the approval by the city electors of the
proposal; and
  (b) Present the certificate to the district board.
  (2) If the electors of the district approve the annexation, the
district board shall:
  (a) Certify the results of the election; and
  (b) Attach the certificate to the certificate of the city and
present both certificates to the county board.
  (3) Upon receipt of the certificate of the city governing body
and the district board, the county board shall enter an order
annexing the territory included in the city to the
 { + affected + } district. When the county board enters the
order, the city territory  { - , together with any territory
thereafter annexed to the city - } :
  (a) Shall be included in the boundaries of the
 { + affected + } district; and
  (b) Shall be subject to all liabilities of the
 { + affected + } district in the same manner and to the same
extent as other territory included in the  { + affected + }
district.
   { +  (4) Notwithstanding ORS 198.720, territory that is
annexed to a city after the annexation of the city to a district:
  (a) Shall be included in the boundaries of the affected
district;
  (b) Shall be withdrawn from the boundaries of the district that
previously serviced the territory if that district is formed
under the same principal Act as the affected district; and
  (c) Shall be subject to all liabilities of the affected
district in the same manner and to the same extent as other
territory included in the affected district. + }
