brief statement of the essential features of the measure as
introduced.
Establishes Tobacco Settlement Fund. Allocates moneys from fund
to Health Division for tobacco cessation programs.
Declares emergency, effective July 1, 2001.
A BILL FOR AN ACT
Relating to state finance; appropriating money; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 293. + }
SECTION 2. { + (1) The Tobacco Settlement Fund is established
in the State Treasury separate and distinct from the General
Fund. Interest earned by the Tobacco Settlement Fund shall be
credited to the fund. The fund shall consist of:
(a) All moneys paid to this state by United States tobacco
products manufacturers under the Master Settlement Agreement of
1998;
(b) Any other moneys appropriated to the fund by the
Legislative Assembly; and
(c) Earnings on moneys in the fund.
(2) Moneys in the Tobacco Settlement Fund are continuously
appropriated to the Oregon Department of Administrative Services
to be expended for purposes provided by law. + }
SECTION 3. { + There is allocated to the Health Division of
the Department of Human Services, for the biennium beginning July
1, 2001, out of the Tobacco Settlement Fund, the amount of $17.6
million to be used for tobacco cessation programs. + }
SECTION 4. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
