SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Directs Department of Education to award grants to certain
small school districts for operation and other expenses of
certain small elementary schools.
Appropriates moneys from General Fund to Department of
Education for grant program.
Declares emergency, effective July 1, 2001.
A BILL FOR AN ACT
Relating to small elementary schools; appropriating money; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section:
(a) 'Small elementary school' means a public elementary school
that:
(A) Serves only kindergarten through grade eight;
(B) Had an average daily membership (ADM), as defined in ORS
327.006, of less than 120 during the 2000-2001 school year;
(C) Does not qualify as a remote small elementary school under
ORS 327.077; and
(D) Is more than eight miles by the nearest traveled road from
another public elementary school in the same school district.
(b) 'Small school district' means a school district that:
(A) Had an ADM of less than 400 during the 2000-2001 school
year; and
(B) Has no more than two public elementary schools within the
school district.
(2) During each of the 2001-2002 and 2002-2003 school years the
Department of Education shall award a grant to any small school
district that had a small elementary school during the 2000-2001
school year.
(3) A small school district that receives a grant under this
section shall use the grant for operation and other expenses of
the small elementary school.
(4) The department shall determine the amount of a grant based
on the amount of moneys available and the number of school
districts that qualify for a grant.
(5) The State Board of Education may adopt any rules necessary
for the administration of this section. + }
SECTION 2. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Education, for the biennium beginning July 1, 2001, out of the
General Fund, the amount of $___, for distribution to small
school districts through the grant program created by section 1
of this 2001 Act. + }
SECTION 3. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
