SUMMARY

brief statement of the essential features of the measure as
introduced.
Allocates moneys deposited into Watershed Improvement Operating
Fund to various state agencies to implement section 4 (5),
Article XV of Oregon Constitution.
Allocates moneys deposited into Watershed Improvement Grant
Fund to various state agencies to implement section 4 (5),
Article XV of Oregon Constitution.
Limits biennial expenditures.
Directs Oregon Watershed Enhancement Board to establish by rule
process for allocating available moneys in Restoration and
Protection Subaccount of Parks and Natural Resources Fund.
Subjects agencies receiving moneys in this 2001 Act to Oregon
Department of Administrative Services allotment process.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to state financial administration; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Of the moneys deposited into the Watershed
Improvement Operating Fund established under ORS 541.379, the
Oregon Watershed Enhancement Board shall allocate $2,873,867 to
the Department of State Police for fish and wildlife activities
to implement section 4 (5), Article XV of the Oregon
Constitution. + }
SECTION 2. { + Of the moneys deposited into the Watershed
Improvement Operating Fund established under ORS 541.379, the
Oregon Watershed Enhancement Board shall allocate $1,688,035 to
the State Department of Fish and Wildlife for activities and
projects to implement section 4 (5), Article XV of the Oregon
Constitution. + }
SECTION 3. { + Of the moneys deposited into the Watershed
Improvement Operating Fund established under ORS 541.379, the
Oregon Watershed Enhancement Board shall allocate $2,500,673 to
the State Department of Agriculture for activities and projects
to implement section 4 (5), Article XV of the Oregon
Constitution. + }
SECTION 4. { + Of the moneys deposited into the Watershed
Improvement Operating Fund established under ORS 541.379, the
Oregon Watershed Enhancement Board shall allocate $192,000 to the
Department of Environmental Quality for activities and projects
to implement section 4 (5), Article XV of the Oregon
Constitution. + }
SECTION 5. { + Notwithstanding any other law, the amount of
$36,282,257 is established for the biennium beginning July 1,
2001, as the maximum limit for the payment of expenses from
lottery moneys from the Parks and Natural Resources Fund to the
Oregon Watershed Enhancement Board for operating expenses,
activities and projects to implement section 4 (5), Article XV of
the Oregon Constitution. + }
SECTION 6. { + Of the moneys deposited into the Watershed
Improvement Grant Fund established under ORS 541.397, the Oregon
Watershed Enhancement Board shall allocate $542,404 to the
Department of State Police for expenses of implementing section 4
(5), Article XV of the Oregon Constitution. + }
SECTION 7. { + Of the moneys deposited into the Watershed
Improvement Grant Fund established under ORS 541.397, the Oregon
Watershed Enhancement Board shall allocate $1,193,366 to the
State Department of Agriculture for activities and projects to
implement section 4 (5), Article XV of the Oregon
Constitution. + }
SECTION 8. { + Notwithstanding any other law, the amount of $1
is established for the biennium beginning July 1, 2001, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, excluding lottery
funds and federal funds, collected or received by the Oregon
Watershed Enhancement Board from the Restoration and Protection
Research Fund. + }
SECTION 9. { + Notwithstanding any other law, the amount of
$9,000,000 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses for agency
operations related to Oregon Plan activities from federal funds
collected or received by the Oregon Watershed Enhancement
Board. + }
SECTION 10. { + Notwithstanding any other law, the amount of
$8,020,000 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from federal
funds in the Watershed Improvement Grant Fund carried over from
the 1999-2001 biennium for the Oregon Watershed Enhancement
Board. + }
SECTION 11. { + (1) The appropriations made from the General
Fund under chapter 6, Oregon Laws 1997, as modified by the
Emergency Board, for the biennium ending June 30, 1999, to the
Oregon Watershed Enhancement Board for watershed improvement
grants during the 1997-1999 biennium are available continuously
until expended for the purposes specified in chapter 6, Oregon
Laws 1997.
(2) Not later than the 60th day after completion of all
projects described in subsection (1) of this section, the
executive director of the Oregon Watershed Enhancement Board
shall certify to the Oregon Department of Administrative Services
the completion of the projects and the amount of any unobligated
balance of the appropriation made by chapter 6, Oregon Laws 1997.
Upon certification, the unobligated balance reverts to the
General Fund. + }
SECTION 12. { + (1) The appropriations made from the General
Fund under chapter 910, Oregon Laws 1999, for the biennium ending
June 30, 2001, to the Oregon Watershed Enhancement Board for
assessment and monitoring during the 1999-2001 biennium are
available continuously until expended for the purposes specified
in chapter 910, Oregon Laws 1999.
(2) Not later than the 60th day after completion of all
projects described in subsection (1) of this section, the
executive director of the Oregon Watershed Enhancement Board
shall certify to the Oregon Department of Administrative Services
the completion of the projects and the amount of any unobligated
balance of the appropriation made by chapter 910, Oregon Laws
1999. Upon certification, the unobligated balance reverts to the
General Fund. + }
SECTION 13. { + Notwithstanding any other law, the amount of
$1,249,995 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from fees,
moneys or other revenues, including Miscellaneous Receipts,
excluding lottery funds, for agency operations related to Oregon
Plan activities collected or received by the Oregon Watershed
Enhancement Board. + }
SECTION 14. { + Notwithstanding any other law, the amount of
$600,000 is established for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, excluding
lottery funds, in the Watershed Improvement Grant Fund carried
over from the 1999-2001 biennium for the Oregon Watershed
Enhancement Board. + }
SECTION 15. { + Notwithstanding any other law, the amount of
$10,501,934 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from lottery
funds carried over from the 1999-2001 biennium for the Water
Resources Department. + }
SECTION 16. { + (1) The Oregon Watershed Enhancement Board
shall establish by rule a process for allocating available moneys
in the Restoration and Protection Subaccount of the Parks and
Natural Resources Fund on a quarterly basis to fulfill the
biennial allocations made in this 2001 Act. Except as provided in
subsection (2) of this section, all quarterly allocations shall
be set at one-eighth of the biennial allocations.
(2) If, in any quarter, the moneys transferred from the State
Lottery Fund to the Parks and Natural Resources Fund are
insufficient to pay for the quarterly allocations established
under this 2001 Act, these allocations shall be reduced
proportionately in sufficient amounts to accommodate the revenue
shortfall. + }
SECTION 17. { + Notwithstanding any other law, all sections of
this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling and encumbering
funds. + }
SECTION 18. { + This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2001 Act takes effect on
its passage. + }
