                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Requires permit for operation of motor vehicle with studded
tires. Establishes permit fee.
  Appropriates moneys from permit fee to Department of
Transportation for repair of highway damage caused by studded
tires.
  Punishes violation by maximum fine of $150.
 
                        A BILL FOR AN ACT
Relating to studded tires; and appropriating money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 to 3 of this 2001 Act are added to
and made a part of the Oregon Vehicle Code. + }
  SECTION 2.  { + (1) The Department of Transportation shall
issue permits for the use of studded tires.
  (2) A permit issued under this section:
  (a) Is valid for a 12-month period; and
  (b) Does not authorize use of studded tires when the use is not
permitted under ORS 815.165.
  (3) The fee for a permit issued under this section is $100 per
year.
  (4) Moneys collected by the department for permits issued under
this section are continuously appropriated to the department to
be used for repair of highway damage caused by studded tires. + }
  SECTION 3.  { + (1) A person commits the offense of operating a
motor vehicle with studded tires without a permit if the person
operates a vehicle that is registered in Oregon and that has
studded tires and the person does not have a current permit
issued under section 2 of this 2001 Act.
  (2) This section applies only to vehicles exempted under ORS
815.165 (7).
  (3) The offense described in this section, operating a motor
vehicle with studded tires without a permit, is a Class C traffic
violation. + }
