                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Prohibits Secretary of State in winding up affairs of Oil Heat
Commission from collecting certain assessments from heating oil
marketers. Declares assessments for specified time period null
and void. Requires Secretary of State to refund assessments
previously collected for specified time period.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to oil marketer assessments; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Notwithstanding ORS 182.080 and section 1,
chapter 880, Oregon Laws 1999, the Secretary of State shall cease
collecting assessments from oil marketers for any revenue derived
from the business of being an oil marketer during the period
beginning on August 1, 1997, and ending on October 4, 1997. All
assessments accruing for that time period are null and void.
  (2) The Secretary of State shall refund to oil marketers any
assessments previously collected from oil marketers for the time
period described in subsection (1) of this section. + }
  SECTION 2.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
