                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Directs Trustees of State Library to award grants to libraries
 { + and groups of libraries + } to provide access to electronic
information resources. Directs State Library to appoint steering
committee to advise on grant distribution.
  Creates legislative interim task force to study access to
electronic information through libraries.
  Appropriates moneys from General Fund to State Library for
grants.
  Declares emergency, effective July 1, 2001.
 
                        A BILL FOR AN ACT
Relating to libraries; creating new provisions; amending ORS
  357.206; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 357.206 is amended to read:
  357.206. The state shall provide financial assistance for
library resource sharing activities to public libraries { + ,
school libraries + } and academic libraries from funds
specifically appropriated therefor in order to implement ORS
357.005 (2)(d), which provides for a statewide network of all
types of libraries.   { +  In addition to individual libraries, a
grant under this section may be awarded to a consortium of
libraries. + } The grants shall be expended for one or more of
the following purposes:
  (1) To reimburse a library that provides more interlibrary
loans of materials to other libraries than it borrows for its own
users;
  (2) To reimburse a library that serves as a regional center for
the referral of reference questions from other libraries;

  (3) To reimburse a public library that provides more direct
loans of materials to users of other public libraries than its
users receive from other public libraries { + ; and
  (4) To provide funds to allow public access to electronic
information resources + }.
 
  SECTION 2.  { + Sections 3 and 4 of this 2001 Act are added to
and made a part of ORS 357.203 to 357.212. + }
  SECTION 3.  { + For the 2001-2003 biennium, the Trustees of the
State Library may award grants to individual libraries and
consortia of libraries under ORS 357.206 (4) for the following
purposes:
  (1) To provide public access to a core group of reference and
research materials in the form of full-text electronic
information and indexes;
  (2) To provide Internet-based technology assistance to promote
information literacy and to help all of Oregon's citizens use the
core group of reference and research materials;
  (3) To provide information to improve user access to print
materials in libraries statewide; and
  (4) To provide assistance to libraries to achieve statewide
participation in a courier system to aid in the sharing of
library materials. + }
  SECTION 4.  { + (1) The State Library shall create a steering
committee to advise the Trustees of the State Library in awarding
grants under ORS 357.206 (4) related to electronic information
resources.
  (2) The steering committee shall have representatives of the
following communities of interest:
  (a) Public libraries;
  (b) Kindergarten through grade 12 school libraries;
  (c) Community college libraries;
  (d) State System of Higher Education libraries; and
  (e) Independent college and university libraries.
  (3) Public and private entities representing the communities of
interest listed in subsection (2) of this section may nominate
members to the State Library for participation on the steering
committee. + }
  SECTION 5.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the State Library, for
the biennium beginning July 1, 2001, out of the General Fund, the
amount of $5.4 million, which may be expended for grants to
public libraries, school libraries and academic libraries under
section 3 of this 2001 Act. + }
  SECTION 6.  { + (1) During the 2001-2003 biennium, there is
created an Interim Task Force on Access to Information Through
Libraries consisting of 16 members.
  (2) The President of the Senate shall appoint:
  (a) Two members from among members of the Senate, one of whom
shall be the cochairperson of the task force as designated by the
president.
  (b) Five members who represent each of the following
communities of interest:
  (A) Public libraries;
  (B) Kindergarten through grade 12 school libraries;
  (C) Community college libraries;
  (D) State System of Higher Education libraries; and
  (E) Independent college and university libraries.
  (3) The Speaker of the House of Representatives shall appoint:
  (a) Three members from among the members of the House of
Representatives, one of whom shall be the cochairperson of the
task force as designated by the speaker.
  (b) Five members who represent each of the following
communities of interest:
  (A) Public libraries;
  (B) Kindergarten through grade 12 school libraries;
  (C) Community college libraries;
  (D) State System of Higher Education libraries; and
  (E) Independent college and university libraries.
  (4) The State Librarian shall serve as an ex officio, nonvoting
member of the task force.
  (5) The task force shall:
  (a) Analyze successful models from other states for providing
access to electronic information resources through libraries;
  (b) Develop goals for statewide cooperative library
initiatives; and
  (c) Develop legislative recommendations concerning funding,
structure and governance of an organization to support ongoing
electronic information access activities.
  (6) Except as provided in this section, the task force is
subject to the provisions of ORS 171.605 to 171.635 and has the
authority contained in ORS 171.505 and 171.510. The task force
shall file its written report prior to October 1, 2002.
  (7) The appointing authorities, in consultation with the task
force cochairpersons, shall develop a work plan consisting of a
list of subjects for study by the task force and the duration of
the study. The work plan developed for the task force shall be
filed with the Legislative Administrator.
  (8) Task force work plans may be modified only by the
appointing authorities after consultation with the task force
cochairpersons. The task force, by official action, may request
such a modification.
  (9) The Legislative Administrator may cause to be employed such
persons as are necessary to the performance of the functions of
the task force. The Legislative Administrator shall fix the
duties and amounts of compensation of such employees. The task
force shall use the services of permanent legislative staff to
the greatest extent practicable.
  (10) Members of the Legislative Assembly who serve on the task
force shall be entitled to an allowance as authorized by ORS
171.072. Nonlegislative members of the task force shall be
entitled to compensation and expenses as provided in ORS 292.495.
Claims for expenses incurred in performing functions of the task
force shall be paid out of funds appropriated for that purpose.
  (11) All agencies, departments and officers of this state are
directed to assist the task force in the performance of its
functions and to furnish such information and advice as the
members of the task force consider necessary to perform their
functions.
  (12) Subject to the approval of the Emergency Board, the task
force may accept contributions of funds and assistance from the
United States Government or its agencies, or from any other
source, public or private, and agree to conditions thereon not
inconsistent with the purposes of the task force. All such funds
are to aid in financing the functions of the task force and shall
be deposited in the General Fund of the State Treasury to the
credit of separate accounts for the task force and shall be
disbursed for the purpose for which contributed in the same
manner as funds appropriated for the task force.
  (13) Official action by the task force shall require the
approval of a majority of the members of the task force. All
legislation recommended by official action of the task force must
indicate that it is introduced at the request of the task force.
Such legislation shall be prepared in time for presession filing
pursuant to ORS 171.130. + }
  SECTION 7.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
