Prohibits Land Conservation and Development Commission from
enforcing rule requiring farm income as condition for approving
farm dwelling unless affected local government demonstrates that
farm tract is capable of producing specified income.
A BILL FOR AN ACT
Relating to farm dwelling rules of Land Conservation and
Development Commission.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 215. + }
SECTION 2. { + The Land Conservation and Development
Commission shall not enforce a rule imposing a farm income
standard as a condition for approving a dwelling under ORS
215.213 (1)(g) or 215.283 (1)(f) unless the local government can
demonstrate that the tract upon which the dwelling will be sited
is capable of producing the required income from farm crops
customarily grown within the jurisdiction of the local
government. In addition, the local government must demonstrate
that the tract is capable of producing a net farm income equal to
20 percent of the farm income standard if the standard is based
on annual gross farm income. + }
