  On page 1 of the printed A-engrossed bill, line 3, after '
167.330,' insert '167.335,'.
  In line 5, delete 'Sections 2 and' and insert 'Section ' and
delete 'are' and insert 'is'.
  Delete lines 7 through 11 and insert:
  '  { +  NOTE: + } Section 2 was deleted by amendment.
Subsequent sections were not renumbered.'.
  On page 2, line 5, delete 'or section 2 of this 2001 Act'.
  In line 11, delete 'shall' and insert 'may'.
  In line 12, after 'psychiatric' insert ', psychological or
mental health'.
  In line 13, delete 'shall' and insert 'may'.
  In line 17, delete 'must' and insert 'may'.
  In line 18, after 'psychiatric' insert ', psychological or

  On page 4, delete lines 6 through 18 and insert:
  '  { +  SECTION 9. + } ORS 167.322 is amended to read:
  ' 167.322. (1) A person commits the crime of aggravated animal
abuse in the first degree if the person:
  ' (a) Maliciously kills an animal; or
  ' (b) Intentionally or knowingly tortures an animal.
  ' (2) Aggravated animal abuse in the first degree is a Class C
felony.

  ' (a) + } 'Maliciously' means intentionally acting with a
depravity of mind and reckless and wanton disregard of life.

  On page 5, line 24, delete 'abuse, neglect'.
  In line 25, delete 'or abandonment in' and insert 'a'.
  On page 6, line 2, delete 'abuse, neglect or abandonment ' and
insert 'the violation'.
  Delete line 4 and insert 'the violation.'.
