                        A BILL FOR AN ACT
Relating to gambling; amending ORS 167.132.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 167.132 is amended to read:
  167.132. (1) A person commits the crime of possession of
gambling records in the second degree if, with knowledge of the
contents thereof, the person possesses any writing, paper,
instrument or article:
  (a) Of a kind commonly used in the operation or promotion of a
bookmaking scheme or enterprise; or
  (b) Of a kind commonly used in the operation, promotion or
playing of a lottery or numbers scheme or enterprise.
  (2) Possession of gambling records in the second degree is a
Class A misdemeanor.
   { +  (3) This section does not apply if the writing, paper,
instrument or article originates from a lottery that is lawfully
operated under the laws of a state and the person possesses the
writing, paper, instrument or article solely in the person's
capacity as a player. + }
