  On page 1 of the printed bill, line 3, after the semicolon
delete the rest of the line and insert 'repealing ORS 801.570;
and declaring an emergency.'.
  On page 6, line 33, after 'section' insert 'and the costs
associated with department responsibilities under ORS 267.230
(2)'.
  In line 34, after the period insert 'Fees collected by the
department that are in excess of the combined actual cost of the
safety program and the costs associated with department
responsibilities under ORS 267.230 (2) shall be refunded to
operators of rail fixed guideway systems within one year
following the end of the fiscal year in which the department
collected the excess fees. In lieu of a refund, an operator of a
rail fixed guideway system may choose to have the excess fees
credited against the subsequent year's fee payment.'.
  After line 35, insert:

the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2001 Act
takes effect on its passage.'. + }
