                     SENATE MINORITY REPORT
                          AMENDMENTS TO
                         SENATE BILL 397

President Derfler:
  A minority of your Committee on Revenue, to whom was referred
Senate Bill 397, having had the same under consideration,
respectfully reports it back with the recommendation that it do
pass with the following amendments:
 
  On page 22 of the printed bill, line 4, delete '2002' and
insert '2003'.
  After line 4, insert:
  '  { +  SECTION 4. + }  { + (1) Section 3 of this 2001 Act and
the amendments to ORS 657.439 and 657.462 by sections 1 and 2 of
this 2001 Act do not become operative if the Employment
Department calculates in September 2002 that the amendments to
ORS 657.439 and 657.462 by sections 1 and 2 of this 2001 Act
would cause the department to change the tax rate schedule in
effect during the calendar year 2003, 2004, 2005 or 2006 to a
higher schedule than would be in effect during the calendar year
2003, 2004, 2005 or 2006 without the amendments to ORS 657.439
and 657.462 by sections 1 and 2 of this 2001 Act.
  ' (2) The department shall report its calculations made under
subsection (1) of this section to the Governor, the President of
the Senate, the Speaker of the House of Representatives and the
Office of the Legislative Counsel by October 31, 2002. + } ' .
