  On page 1 of the printed bill, line 5, after the period delete
the rest of the line and lines 6 and 7 and insert '(1) A civil
penalty may be imposed in the manner provided in ORS 183.090 on
any person who violates any provision of ORS 323.005 to 323.455.
A civil penalty imposed under this subsection may not exceed
$1,000 per violation.'.
  In line 8, after '(2)' insert '(a)'.
  After line 13, insert:
  ' (b) This subsection does not apply to a person who
distributes fewer than 60,000 cigarettes.'.
  Delete lines 14 through 20.
  In line 21, restore '(3)' and delete '(4)'.
  Delete lines 27 through 30.
  On page 2, delete line 1.
  In line 2, delete '(6)' and insert '(4)(a)'.
  Delete lines 6 through 8 and insert:
  ' (b) This subsection does not apply to a transporter who
transports or possesses or acquires for the purpose of
transporting fewer than 60,000 cigarettes.'.
  In line 9, restore '(5)' and delete '(8)'.
  Delete lines 13 through 15.
  In line 16, delete '(10)' and insert '(6)'.
