                             AN ACT
 
 
Relating to courts; creating new provisions; amending section 8,
  chapter 1085, Oregon Laws 1999; and declaring an emergency.
 
Be It Enacted by the People of the State of Oregon:
 
  SECTION 1. Section 8, chapter 1085, Oregon Laws 1999, is
amended to read:
   { +  Sec. 8. + } (1)   { - Section 4 of this 1999 Act - }
 { +  ORS 10.061 + } and the amendments to ORS 10.065, 10.075 and
221.349 by sections 5, 6 and 7   { - of this 1999 Act - }  { + ,
chapter 1085, Oregon Laws 1999, + } become operative on
 { - July 1, 2001 - }   { + January 1, 2002 + }.
  (2)   { - Section 4 of this 1999 Act - }  { +  ORS 10.061 + }
and the amendments to ORS 10.065, 10.075 and 221.349 by sections
5, 6 and 7   { - of this 1999 Act - }  { + , chapter 1085, Oregon
Laws 1999, + } apply only to jurors summoned on or after
 { - July 1, 2001 - }  { +  January 1, 2002 + }.
  SECTION 2.  { + (1) The fees of jurors shall be as follows:
  (a) For each day's required attendance upon a court of record,
$10.
  (b) For each juror sworn in the justice court, or upon an
inquest, $10.
  (2) In addition to the fees and mileage prescribed in
subsection (1) of this section and ORS 10.065, the governing body
of a county may provide by ordinance for reimbursement by the
county of jurors for mileage and other expenses incurred in
serving as jurors. + }
  SECTION 3.  { + Section 2 of this 2001 Act is repealed January
1, 2002. + }
  SECTION 4.  { + If this 2001 Act does not become effective
until after July 1, 2001, the amendments to section 8, chapter
1085, Oregon Laws 1999, by section 1 of this 2001 Act shall be
operative retroactively to that date, and any failure to pay the
juror fees and mileage fees required by ORS 10.061 or 10.065, as
amended by section 5, chapter 1085, Oregon Laws 1999, is ratified
and approved. + }
  SECTION 5.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
