  '  { +  SECTION 2. + }  { + (1) The amendments to ORS 188.135
by section 1 of this 2001 Act, section 3 of this 2001 Act and
this section shall not have the effect of disqualifying from
office any person who, on the basis of residency in a
congressional district, was selected to any public office before
the operative date of the amendments to ORS 188.135 by section 1
of this 2001 Act or is holding any public office on the operative
date of the amendments to ORS 188.135 by section 1 of this 2001
Act, nor of terminating any term of office sooner than it would
otherwise expire.
  ' (2) Incumbent members of the Congress of the United States
from this state shall continue to be incumbents of the districts
bearing the same numbers as the districts from which they were
elected until the expiration of their terms.
  ' (3) Notwithstanding any provision of ORS chapter 249, if a
person has filed a declaration of candidacy, nominating petition
or certificate of nomination for the office of Representative to
the Congress of the United States prior to the effective date of
this 2001 Act, the declaration, petition or certificate shall be
considered a filing for the district established in ORS 188.135,
as amended by section 1 of this 2001 Act, bearing the same number
as the district for which the filing was originally made. + }
  '  { +  SECTION 3.  + }  { +  (1) Except as provided in
subsection (2) of this section, the amendments to ORS 188.135 by
section 1 of this 2001 Act shall not become operative until the
date of the regular general election held in 2002.
  ' (2) Notwithstanding subsection (1) of this section, the
amendments to ORS 188.135 by section 1 of this 2001 Act shall be
operative on the effective date of this 2001 Act for the purpose
of nomination of candidates to be voted upon for the office of
Representative to the Congress of the United States at the
regular general election held in 2002.
  ' (3) As used in this section, 'nomination of candidates '
means the nomination of candidates by a major political party at
the biennial primary election as provided in ORS chapter 249 and
the nomination of candidates by other than a major political
party as provided in ORS chapter 249. + }
  '  { +  SECTION 4. + }  { + This 2001 Act being necessary for
the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2001 Act
takes effect on its passage. + } ' .
