SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Creates positions of Senator Emeritus and Representative
Emeritus. Prescribes procedures for selection and removal.
Prescribes qualifications for office and limitations on political
activities. Requires Senator Emeritus and Representative Emeritus
to instruct members of Legislative Assembly and staff in history,
rules and decorum of Legislative Assembly.
Appropriates moneys to Legislative Assembly for purposes of
Act.
A BILL FOR AN ACT
Relating to members emeriti of the Legislative Assembly; and
appropriating money.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) There are created within the legislative
department two offices of Senator Emeritus and two offices of
Representative Emeritus.
(2)(a) A Senator Emeritus shall be elected and may be removed
from office by a two-thirds vote of the members present in the
Senate.
(b) A Representative Emeritus shall be elected and may be
removed from office by a two-thirds vote of the members present
in the House of Representatives.
(3)(a) A person may serve as Senator Emeritus if the person
served in the Senate and, at the time of election, has not held
an elective office for seven years.
(b) A person may serve as Representative Emeritus if the person
served in the House of Representatives and, at the time of
election, has not held an elective office for seven years.
(4) The term of a Senator or Representative Emeritus expires at
the convening of the Legislative Assembly in regular session next
following the election of the Senator or Representative
Emeritus. + }
SECTION 2. { + (1)(a) The majority and minority leaders in the
Senate shall fix the salary of a Senator Emeritus.
(b) The majority and minority leaders in the House of
Representatives shall fix the salary of a Representative
Emeritus.
(2)(a) The Secretary of the Senate shall provide a Senator
Emeritus with a desk in the Senate chamber and a suitable and
sufficient office convenient to the chamber.
(b) Subject to the approval of the majority and minority
leaders in the Senate, the secretary may employ and fix the
compensation of the assistants and clerks the secretary considers
necessary for the effective conduct of the work of the Senators
Emeriti.
(3)(a) The Chief Clerk of the House of Representatives shall
provide a Representative Emeritus with a desk in the chamber of
the House of Representatives and a suitable and sufficient office
convenient to the chamber.
(b) Subject to the approval of the majority and minority
leaders in the House of Representatives, the chief clerk may
employ and fix the compensation of the assistants and clerks the
chief clerk considers necessary for the effective conduct of the
work of the Representatives Emeriti. + }
SECTION 3. { + (1) A Senator and Representative Emeritus
shall:
(a) Instruct members and members' staffs in the history, rules
and decorum of the Legislative Assembly.
(b) Instruct members on how to conduct a debate and question
another member.
(2)(a) A Senator Emeritus shall have the privileges of a member
of the Senate on the floor, including the right to request
courtesies of the Senate and to remonstrate, but may not speak or
vote on a measure.
(b) A Representative Emeritus shall have the privileges of a
member of the House of Representatives on the floor, including
the right to request courtesies of the House of Representatives
and to remonstrate, but may not speak or vote on a measure. + }
SECTION 4. { + (1) The offices of Senator and Representative
Emeritus are nonpartisan offices.
(2) While a Senator or Representative Emeritus, an individual
may not:
(a) Be a candidate or committee director as defined in ORS
260.005.
(b) Support or oppose a legislative measure or legislative
candidate. + }
SECTION 5. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Legislative Assembly,
for the biennium beginning July 1, 2001, out of the General Fund,
the amount of $___ for the purpose of carrying out this 2001
Act. + }
