SUMMARY

brief statement of the essential features of the measure as
introduced.
Declares policy of State of Oregon in regard to wild and
hatchery salmon and steelhead. Defines indigenous for purposes of
policy.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to salmonids; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) It is the policy of the State of Oregon
that all species of indigenous anadromous salmonids, wild and
hatchery produced, shall:
(a) Be allowed to complete their natural life cycle;
(b) Not be harmed, harassed, taken or destroyed except by sport
or commercial angling or for hatchery production; and
(c) Be allowed to return to unobstructed natural spawning
areas.
(2) Pursuant to this policy, state agencies with regulatory
authority over indigenous anadromous salmonids shall ensure that:
(a) All eggs or milt taken from indigenous anadromous salmonids
are used to propagate the species and are not disposed of or
otherwise destroyed.
(b) Indigenous anadromous salmonids used for hatchery
production are returned to the waters of this state to aid in the
return of nutrients to the natural environment.
(c) Man-made weirs, gates and other obstructions provide
passage for indigenous anadromous salmonids.
(3) As used in this section, 'indigenous' means a salmonid that
is:
(a) Descended genetically from a population that is believed,
through the application of established scientific principles, to
have been present in the same geographical area prior to January
1, 1800; or
(b) Descended from a natural colonization after January 1,
1800, by an indigenous population. + }
SECTION 2. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
