Creates mandatory minimum sentence of five years for person
convicted for third time of felony having fraud as material
element.
A BILL FOR AN ACT
Relating to sentencing.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) When a person is convicted of a felony that
has fraud as a material element, the court shall impose, and the
person shall serve, a term of imprisonment of at least five years
if the person has at least two previous convictions for felonies,
each of which has fraud as a material element.
(2) A person serving a term of imprisonment pursuant to
subsection (1) of this section is not, during the service of the
term of imprisonment, eligible for release on post-prison
supervision or any form of temporary release. The person is not
eligible for any reduction in the minimum sentence for any
reason. The court may impose a greater sentence if otherwise
permitted by law.
(3) As used in this section, 'previous conviction ' includes:
(a) Convictions occurring before, on or after the effective
date of this 2001 Act;
(b) Convictions entered in any other state or federal court for
comparable offenses; and
(c) Convictions entered in the same proceeding as the
conviction for which the person is being sentenced under this
