                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Limits compensation of lottery game retailers based on net
revenues from video lottery games.
  Requires Oregon State Lottery Commission to certify additional
amount available as result of decrease in compensation.
  Allocates certified amount to Oregon Department of
Administrative Services for distribution to various agencies for
environmental, law enforcement and children's services.
  Declares emergency, effective July 1, 2001.
 
                        A BILL FOR AN ACT
Relating to the Oregon State Lottery; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 461. + }
  SECTION 2.  { + Notwithstanding ORS 461.310, the compensation
of a lottery game retailer that sells tickets or shares in video
lottery games to the public shall not exceed:
  (1) 35 percent for a retailer whose net receipts from sales of
tickets or shares in video lottery games are less than $200,000
annually.
  (2) 30 percent for a retailer whose net receipts from sales of
tickets or shares in video lottery games are $200,000 or more but
less than $300,000 annually.
  (3) 10 percent for a retailer whose net receipts from sales of
tickets or shares in video lottery games are $300,000 or more
annually. + }
  SECTION 3.  { + (1) In each fiscal year, the Oregon State
Lottery Commission shall certify an estimate of the additional
amount of net proceeds from the Oregon State Lottery that is
available for transfer to the Administrative Services Economic
Development Fund in the fiscal year that is attributable to the
reduction in the compensation of lottery game retailers made by
section 2 of this 2001 Act. The additional amount so certified is
the difference between the total amount of compensation paid to
lottery game retailers under section 2 of this 2001 Act and the
total amount of compensation that would have been paid to the
retailers for the same gross amount of sales of tickets or shares
in video lottery games under compensation schedules that applied
to such compensation prior to the effective date of this 2001
Act.
 
  (2) The Oregon State Lottery Commission shall formulate the
estimate required by subsection (1) of this section by generally
accepted estimation methodologies and with the best available
data.
  (3) The certified estimate under subsection (1) of this section
shall be included in each budget report prepared by the Governor
under ORS 291.202. + }
  SECTION 4.  { + (1) In each fiscal year commencing on July 1,
2001, there is allocated to the Oregon Department of
Administrative Services from the Administrative Services Economic
Development Fund the amount certified by the Oregon State Lottery
Commission for the fiscal year under section 3 of this 2001 Act.
  (2) An allocation of moneys from the Administrative Services
Economic Development Fund under this section is subject to the
requirements in section 4, Article XV of the Oregon Constitution,
for deposit of 15 percent of the net proceeds from the Oregon
State Lottery into the Education Endowment Fund and another 15
percent of the net lottery proceeds into the Parks and Natural
Resources Fund and shall be made only after satisfaction or
payment of:
  (a) Amounts allocated to Westside lottery bonds issued under
ORS 391.140 or to the reserves or any refunding related to the
Westside lottery bonds in accordance with the priority for
allocation and disbursement established by ORS 391.130;
  (b) All liens, pledges or other obligations relating to lottery
bonds or refunding lottery bonds that are due or payable during
the fiscal year for which the allocation is made; and
  (c) Amounts required by any other pledges of, or liens on, net
proceeds from the Oregon State Lottery. + }
  SECTION 5.  { + In each fiscal year, the Oregon Department of
Administrative Services shall transfer moneys allocated to the
department from the Administrative Services Economic Development
Fund under section 4 of this 2001 Act in the following amounts
for the following purposes:
  (1) One-quarter of the total allocated amount to the Department
of Environmental Quality to provide grants and other financial
assistance to local agencies for elimination of hazardous sites
and conditions caused by the manufacture of illegal drugs, such
as methamphetamine.
  (2) One-quarter of the total allocated amount to interagency
narcotics teams established by state and local law enforcement
agencies.
  (3) One-quarter of the total allocated amount to the Department
of Education for financial assistance to the Oregon
prekindergarten programs under ORS chapter 329, the program of
early childhood special education and early intervention services
to children from birth to three years of age under ORS chapter
343 and the relief nurseries program.
  (4) Twelve and one-half percent of the total allocated amount
to the counties of this state for after-school activities,
programs and services to children. Moneys shall be distributed to
each county under this subsection in the same proportion as the
population of the unincorporated area of the county bears to the
population of the unincorporated areas of all of the counties in
this state.
  (5) Twelve and one-half percent of the total allocated amount
to the cities of this state for after-school activities, programs
and services to children. Moneys shall be distributed to each
city in this state under this subsection in the same proportion
as the population of the city bears to the population of all the
cities in this state. + }
  SECTION 6.  { + Section 2 of this 2001 Act does not apply to
contracts entered into before the effective date of this 2001
Act.  However, section 2 of this 2001 Act applies to a renewal or
extension of an existing contract on or after the effective date
of this 2001 Act. + }
  SECTION 7.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
