                             SUMMARY

  Requires Department of Transportation to make specified
determinations when doing flat fee study.
  Requires Legislative Assembly to review recommendations of
department regarding adjustment of flat fee rates.
 
                        A BILL FOR AN ACT
Relating to flat fee rates; amending ORS 825.482.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 825.482 is amended to read:
  825.482.  { + (1) + } The Department of Transportation and the
Oregon Transportation Commission shall review flat fee rates
established under ORS 825.480 in each even-numbered year { + .
  (2) As part of the review conducted under this section, the
department shall select a sample of motor carriers that pay flat
fees and shall distribute questionnaires to and conduct
interviews with the selected carriers in order to determine for
each carrier:
  (a) The percentage of total miles traveled that occurs on
Oregon highways;
  (b) The percentage of total miles traveled carrying a full load
and the percentage of total miles traveled with no load; and
  (c) Any other information the department considers necessary to
carry out the purposes of this section.
  (3) + }   { - and - }  { +  The department + } shall recommend
to each regular session of the Legislative Assembly any
adjustments to the flat fee rates that the department and the
commission deem appropriate.
   { +  (4) The Legislative Assembly shall review each
recommendation submitted under subsection (3) of this section and
may enact any changes to ORS 825.480 that are necessary to ensure
that carriers paying fees determined by ORS 825.480 pay as much
as they would pay if they paid taxes under ORS 825.474 and
