SUMMARY

Directs Department of Environmental Quality to contract with
provider of ocean salvage vessels to retain one or more vessels
capable of ocean salvage operations. Specifies conditions of
contract.
Appropriates moneys to department to retain vessels.
Declares emergency, effective July 1, 2001.
A BILL FOR AN ACT
Relating to ocean salvage operations; appropriating money; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Department of Environmental Quality
shall, in accordance with the public contracting provisions of
ORS 279.005 to 279.111, enter into a contract with a provider of
ocean salvage vessels to retain one or more salvage vessels,
capable of major salvage operations, to conduct salvage
operations at any time in the waters of the state.
(2) The department shall ensure that any contract entered into
under this section:
(a) Defines the conditions under which the department may
request salvage operations;
(b) Specifies a time limit by which salvage operations must
commence once requested; and
(c) Requires the operator of any retained vessel, as safety and
prudence allow, to immediately cease all pending salvage
operations and begin the salvage operation requested by the
department. + }
SECTION 2. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Environmental Quality, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $___, which may be
expended for retaining one or more salvage vessels under section
1 of this 2001 Act. + }
SECTION 3. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
