SUMMARY

brief statement of the essential features of the measure as
introduced.
Establishes Racial and Ethnic Health Data Group in Health
Division. Requires group to develop and implement plans for
collection and analysis of health data in culturally appropriate
manner to support efforts to eliminate health disparities in
Oregon.
A BILL FOR AN ACT
Relating to the Racial and Ethnic Health Data Group; and
appropriating money.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) It is declared to be the policy and intent
of the Legislative Assembly that the Racial and Ethnic Health
Data Group in the Health Division of the Department of Human
Services is created to work for the improvement and enhancement
of health data collection in a culturally sensitive and
appropriate manner to support the efforts of this state to
eliminate health disparities in Oregon.
(2) The Racial and Ethnic Health Data Group shall make
recommendations to the Governor and shall report to each regular
session of the Legislative Assembly. + }
SECTION 2. { + (1) The Racial and Ethnic Health Data Group is
created in the Health Division of the Department of Human
Services. The group shall consist of 13 members, appointed as
follows:
(a) Three members appointed by the Governor who are consumers
of health care services in communities of color in Oregon;
(b) Two members appointed by the Governor who represent local
governments; and
(c) One member appointed by the Director of Human Services from
each of the following:
(A) The Oregon Progress Board;
(B) The Health Division of the Department of Human Services;
(C) The Office for Oregon Health Plan Policy and Research;
(D) The Office of Medical Assistance Programs;
(E) The Commission on Asian Affairs;
(F) The Commission on Black Affairs;
(G) The Commission on Hispanic Affairs; and
(H) The Commission on Indian Services.
(2) The membership of the group shall be appointed so as to be
representative of the racial, ethnic, cultural, social and
economic diversity of the people of this state.
(3) A member serves for a three-year term. A member may be
reappointed.
(4) If there is a vacancy for any cause, the appointing
authority shall make an appointment to become immediately
effective for the unexpired term. The appointing authority may
appoint a replacement for any member of the group who misses more
than two consecutive meetings of the group.
(5) The group shall select one member as chairperson and one
member as vice chairperson, for such terms and with duties and
powers as the group determines necessary for the performance of
the functions of such offices.
(6) A majority of the members of the group shall constitute a
quorum for the transaction of business.
(7) Subject to the availability of funds, members of the group
appointed by the Governor shall be paid compensation and expenses
as provided in ORS 292.495 from such funds that may be available
to the group.
(8) The Racial and Ethnic Health Data Group may accept
contributions of funds and assistance from the United States
Government, its agencies or from any other source, public or
private, for purposes consistent with sections 1 to 4 of this
2001 Act. Such contributions are continuously appropriated to the
group for the purposes of sections 1 to 4 of this 2001 Act.
(9) The Health Division of the Department of Human Services
shall provide clerical, technical and management personnel to
serve as the group's staff. + }
SECTION 3. { + The Racial and Ethnic Health Data Group shall
work in cooperation with the Oregon Progress Board to:
(1) Develop a plan for the increased collection of
health-related data for people of color and other
underrepresented populations.
(2) Develop and implement methodologies for the collection of
health-related data in a culturally sensitive and appropriate
manner.
(3) Develop and implement a plan for the inclusion of
communities of color in the planning and administering of
quantitative and qualitative methods of health data collection
and analysis.
(4) Develop and implement a plan that uses a common set of
definitions and provides for the sharing of the data collected,
as authorized by law, with stakeholders and other interested
parties. + }
SECTION 4. { + Nothing in this 2001 Act modifies or changes
any existing legal obligation concerning the confidentiality of
health care records under the law of this state or federal
law. + }
SECTION 5. { + Notwithstanding the term of office specified in
section 2 of this 2001 Act, of the members first appointed to the
Racial and Ethnic Health Data Group:
(1) Two of the members appointed by the Governor who are
consumers of health care services in communities of color in
Oregon and one of the members appointed by the Governor who
represents local governments shall serve for terms ending on July
1, 2003.
(2) Four of the members appointed by the Director of Human
Services shall serve for terms ending on July 1, 2003. + }
