                             SUMMARY

  Creates Office of Multicultural Health. Establishes
Multicultural Health Council to advise Director of Multicultural
Health.
 
                        A BILL FOR AN ACT
Relating to the Office of Multicultural Health.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + There is created the Office of Multicultural
Health. The goal of the office is to improve the health status of
underserved and underrepresented populations in Oregon through
multicultural and culturally competent approaches that influence
how health services are designed and delivered. The office shall:
  (1) Provide the Department of Human Services with resources,
training, assessments and technical assistance;
  (2) Provide the Health Licensing Office, health professional
regulatory boards and other health boards, committees or task
forces with resources, training, assessments and technical
assistance;
  (3) Provide county health departments, community-based
coalitions and other organizations with technical assistance;
  (4) Support the efforts of the Governor's Racial and Ethnic
Health Task Force;
  (5) Provide information for and act as a liaison between state
agency programs and community organizations, service providers
and policy makers;
  (6) Provide public education for and community awareness of
multicultural health issues;
  (7) Encourage citizen participation in governmental decision
making;
  (8) Develop ways to improve multicultural health services
through research, policy analysis and model projects; and
  (9) Represent concerns of underserved and underrepresented
populations in Oregon on issues of multicultural health to the
Governor, Legislative Assembly and state agencies. + }
  SECTION 2.  { + (1) The Office of Multicultural Health shall be
under the supervision and control of the Director of
Multicultural Health, who is responsible for the performance of
the duties, functions and powers of the office. The Governor
shall establish the qualifications for and appoint the director,
who holds office at the pleasure of the Governor.
 
  (2) The director shall receive a salary as provided by law or,
if not so provided, as prescribed by the Governor.
  (3) The director shall provide the office with such services
and employees as the office requires to carry out its duties,
functions and powers. Subject to any applicable provisions of the
State Personnel Relations Law, the director shall appoint all
subordinate officers and employees of the office, prescribe their
duties and fix their compensation. + }
  SECTION 3.  { + The Office of Multicultural Health may accept
contributions of funds and assistance from the United States
Government, its agencies or from any other source, public or
private, and agree to conditions thereon not inconsistent with
the purposes of the office. All such funds shall aid in financing
the duties, functions and powers of the office. + }
  SECTION 4.  { + In accordance with applicable provisions of ORS
183.310 to 183.550, the Director of Multicultural Health may
adopt rules necessary for the administration of sections 1 to 5
of this 2001 Act. + }
  SECTION 5.  { + (1) The Multicultural Health Council is
established to advise the Director of Multicultural Health.
  (2) The council shall consist of no more than nine members.
The council shall select one of its members as chairperson.
Membership in the council shall be as follows:
  (a) Two members shall be members of the Senate, one Democrat
and one Republican, appointed by the President of the Senate;
  (b) Two members shall be members of the House of
Representatives, one Democrat and one Republican, appointed by
the Speaker of the House of Representatives;
  (c) One member shall be the Director of Human Services or the
designee of the director; and
  (d) At the discretion of the Governor, at least two but no more
than four additional members shall be individuals with expertise
in multicultural health issues, appointed by the Governor.
  (3) The term of office for each member is two years, but a
member serves at the pleasure of the appointing authority. Before
the expiration of the term of a member, the appointing authority
shall appoint a successor whose term begins on July 1, next
following. A member is eligible for reappointment. If there is a
vacancy for any cause, the appointing authority shall make an
appointment to become immediately effective for the unexpired
term.
  (4) Notwithstanding the term of office specified by subsection
(3) of this section, of the members first appointed to the
council:
  (a) Four members shall serve for a term ending July 1, 2003.
  (b) No more than five members shall serve for a term ending
July 1, 2005.
  (5) The council shall meet at times and places specified by the
call of the chairperson or a majority of the members of the
council.
  (6) A majority of the members of the council constitutes a
quorum for the transaction of business.
  (7) Members of the council are not entitled to compensation but
may be reimbursed from funds available to the Office of
Multicultural Health for actual and necessary travel and other
expenses incurred in the performance of their official duties as
provided in ORS 292.210 to 292.288.
  (8) The Office of Multicultural Health shall provide staff
necessary for the performance of the functions of the
council. + }
