Prohibits pharmacy from charging price that exceeds Medicaid
fee-for-service rate to Medicare beneficiary with valid
prescription.
A BILL FOR AN ACT
Relating to prescription medications for Medicare beneficiaries.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) Except as provided in subsection (3) of
this section, a pharmacy may not charge a person who presents a
valid prescription and the person's Medicare card a price for
prescription medication that exceeds the Medicaid fee-for-service
rate established by the Department of Human Services.
(2) A pharmacy may charge the person an amount established by
the department to cover the professional dispensing fee.
(3) The provisions of subsections (1) and (2) of this section
do not apply to over-the-counter medications.
(4) The department shall provide a mechanism to calculate and
transmit the Medicaid fee-for-service rate to the pharmacy.
(5) This section applies to any pharmacy that uses an
electronic claims processing or claims management system that
incorporates on-line point of sale. + }
