Allows individual to request that certain health screen tests
be performed directly, at individual's own expense.
A BILL FOR AN ACT
Relating to direct requests for health screen tests.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 438. + }
SECTION 2. { + As used in this section:
(1) 'Direct request' means a request made by an individual
directly to a clinical laboratory for a health screen test that
may be performed by:
(a) A simple blood extraction;
(b) A urine or stool sample; or
(c) A general culture, excluding a biopsy.
(2) Notwithstanding ORS 438.430, an individual may make a
direct request for a health screen test.
(3) An individual who makes a direct request is solely
responsible for the costs of the health screen tests conducted at
the individual's direct request.
(4) A physician may not be required to accept the results of a
direct request.
(5) A clinical laboratory shall release the results of a direct
request to the individual, provided that the results contain
clinical or laboratory readings only and do not include a
diagnosis of any disease or illness. + }
