                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Requires health practitioner licensing boards to select
definition for practitioners and submit proposed changes in
statutory language to Seventy-second Legislative Assembly.
 
                        A BILL FOR AN ACT
Relating to health practitioner licensing boards.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) No later than June 1, 2002, each health
practitioner licensing board listed under subsection (5) of this
section shall select one or more of the definitions under
subsection (3) of this section to be used as the exclusive
statutory definition applicable to practitioners regulated by
that board. Prior to the agency request filing deadline for the
regular session of the Seventy-second Legislative Assembly, each
board shall submit, through the Oregon Department of
Administrative Services, a request for legislation to enact the
definitions selected by the board.
  (2) The board request shall include proposed changes in
statutory language necessary to implement the selected
definition.  The request shall include but need not be limited to
statutory language that implements use of the selected defined
title after the customary professional designation of the
practitioners being regulated, and designation by name of any
appropriate health practitioner licensing board or state or
national nongovernmental organization of peers.
  (3) Each board shall select any of the following definitions as
appropriate: + }
   { +  (a) 'Certified health practitioner' means a person who
has met professional standards established by a recognized state
or national nongovernmental organization of peers. + }
   { +  (b) 'Licensed health practitioner' means a person granted
a license by a state health practitioner licensing board.
  (c) 'Registered health practitioner' means a person who is
registered with the Health Licensing Office but is not licensed
as a health practitioner or subject to disciplinary action by a
health practitioner licensing board. The Health Licensing Office
may by rule determine the criteria required for registry,
including but not limited to:
  (A) Name;
  (B) Address;
  (C) Educational qualifications;
  (D) Work history; and
  (E) Participation in a pre-employment screening.
  (4) Except as provided under this subsection, no definitions
other than the definitions under subsection (3) of this section
shall be applied by a health practitioner licensing board to a
practitioner regulated by the board. Notwithstanding subsection
(1) of this section, a board may, by rule, designate
specializations within a health profession or the grade of
license held when the health practitioner is authorized by the
board to perform actions prohibited to a licensed health
practitioner who is not so designated.
  (5) This section applies to the following health practitioner
licensing boards:
  (a) The Board of Medical Examiners, for acupuncturists and
podiatrists;
  (b) The Health Licensing Office, for hearing aid dealers;
  (c) The State Board of Chiropractic Examiners;
  (d) The Oregon Board of Licensed Professional Counselors and
Therapists;
  (e) The Oregon Board of Dentistry;
  (f) The State Board of Denture Technology;
  (g) The Board of Examiners of Licensed Dietitians;
  (h) The Health Division, for Emergency Medical Technicians;
  (i) The State Board of Massage Therapists;
  (j) The Board of Medical Examiners;
  (k) The Board of Naturopathic Examiners;
  (L) The Oregon State Board of Nursing;
  (m) The Board of Examiners of Nursing Home Administrators;
  (n) The Occupational Therapy Licensing Board;
  (o) The Oregon Board of Optometry;
  (p) The State Board of Pharmacy;
  (q) The Physical Therapist Licensing Board;
  (r) The State Board of Psychologist Examiners;
  (s) The Board of Radiologic Technology;
  (t) The Respiratory Therapist Licensing Board;
  (u) The State Board of Clinical Social Workers; and
  (v) The State Board of Examiners for Speech-Language Pathology
and Audiology.
  (6) Nothing in this section prohibits a health practitioner
from using a customary professional designation other than those
established by definition pursuant to subsection (1) of this
section. + }
