SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Limits biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, including federal
funds, collected or received by Department of Consumer and
Business Services.
Excludes certain fees collected, payments and accounts from
expenditure limitations.
Subjects agency to Oregon Department of Administrative Services
allotment process.
Declares emergency, effective July 1, 2001.
A BILL FOR AN ACT
Relating to the financial administration of the Department of
Consumer and Business Services; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Notwithstanding any other law, $172,363,152 is
established for the biennium beginning July 1, 2001, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, including federal
funds, collected or received by the Department of Consumer and
Business Services for occupational safety and health-related
activities, manufactured home inspections and senior health
insurance benefit programs. + }
SECTION 2. { + Section 1 of this 2001 Act does not limit,
affect or apply to expenditures from the:
(1) Workers' Benefit Fund.
(2) Self-Insured Employer Adjustment Reserve.
(3) Self-Insured Employer Group Adjustment Reserve.
(4) Federal Registry Fund for payment to the Federal Financial
Institutions Examination Council of annual registry fees
collected from state certified and licensed appraisers; Oregon
Medical Insurance Pool Account for payment of claims and third
party administration contracts.
(5) Consumer and Business Services Fund for payment of
contracted collection costs, including contracted processing
costs for the Combined Tax Reporting Program, contracted building
codes permit issuance costs, and workers' compensation paying
agent reimbursements as outlined in ORS 656.307.
(6) Special payments to the Oregon Health Sciences University
for research on occupational illness and disease. + }
SECTION 3. { + Notwithstanding any other law, all sections of
this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering
funds. + }
SECTION 4. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
