Limits biennial expenditures of Department of Education from
federal funds.
Limits payment of expenses by Department of Education for
expenses related to education lottery bonds.
Excludes costs related to certain revolving accounts and funds
or certain donations received from expenditure limitations.

A BILL FOR AN ACT
Relating to the financial administration of the Department of
Education; appropriating money; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:

SECTION 4. { + Notwithstanding any other law, the amount of
$42,400,000 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from lottery
moneys allocated from the Administrative Services Economic
Development Fund for debt service on the outstanding state
education lottery bonds issued during the 1997-1999 and 1999-2001
biennia. + }
SECTION 5. { + Notwithstanding any other law, the amount of
$13,600,000 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from lottery
moneys allocated from the Oregon Education Fund for debt service
on the outstanding state education lottery bonds issued during
the 1997-1999 and 1999-2001 biennia. + }
SECTION 6. { + Notwithstanding any other law, the amount of
$3,555,414 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from Lottery
Bond Fund earnings related to education lottery bonds, Education
Reserve Account earnings, and Project Account earnings, but
excluding lottery funds and federal funds, collected or received
by the Department of Education for debt service on the
outstanding state education lottery bonds issued during the
1997-1999 and 1999-2001 biennia. + }
SECTION 7. { + Section 2 of this 2001 Act does not limit,
affect or apply to distribution of costs related to the School
Lunch Revolving Account, Education Training Revolving Account,
Private Vocational School Tuition Protection Fund, and Distance
Learning Fund; and expenditures made from donations received by
the Oregon State School for the Blind and Oregon State School for
the Deaf. + }
SECTION 8. { + (1) In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, for
the biennium beginning July 1, 2001, out of the General Fund, the
amount of $2,500,000 for allocation to the Department of
Education for professional services related to technology
projects.
(2) If any moneys described in subsection (1) of this section
are not allocated or obligated by the Emergency Board prior to
November 1, 2002, such unallocated and unobligated moneys on that
date become available for any other purpose for which the
Emergency Board may lawfully allocate funds. + }
SECTION 9. { + Notwithstanding any other law, all sections of
this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering
funds. + }
SECTION 10. { + This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2001 Act takes effect
July 1, 2001. + }
