                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Appropriates moneys from General Fund to Department of Higher
Education for biennial expenses and for debt service and
administrative costs relating to general obligation bonds sold to
support higher education institutions.
  Limits biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, excluding lottery
funds and federal funds, collected or received by department.
Limits biennial expenditures from funds allocated to department
from Sports Lottery Account.
  Allows department or State Board of Higher Education to exceed
limitations if additional moneys are available for gift, grant
and contract activities, continuing education, auxiliary
enterprise activities and student loans.
  Subjects Department of Higher Education to Oregon Department of
Administrative Services allotment process.
  Declares emergency, effective July 1, 2001.
 
                        A BILL FOR AN ACT
Relating to the financial administration of Department of Higher
  Education; appropriating money; limiting expenditures; and
  declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + There is appropriated to the Department of
Higher Education for the biennium beginning July 1, 2001, out of
the General Fund, the amount of $645,248,943, which may be
expended for support of education and general services of higher
education. + }
  SECTION 2.  { + Notwithstanding any other law, the amount of
$824,549,696 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from fees,
moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received
by the Department of Higher Education for support of education
and general services of higher education. + }
 
  SECTION 3.  { + Sections 1 and 2 of this 2001 Act do not
prohibit the Department of Higher Education or the State Board of
Higher Education from expending moneys in addition to the
appropriations and limitations made by sections 1 and 2 of this
2001 Act if such additional moneys are otherwise available as
provided by law for expenditure by the department or board for
gift, grant and contract activities, continuing education,
auxiliary enterprise activities and student loans. + }
  SECTION 4.  { + Notwithstanding any other law, the amount of
$5,340,371 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from funds
allocated to the Department of Higher Education from the Sports
Lottery Account. + }
  SECTION 5.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of Higher
Education, for the biennium beginning July 1, 2001, out of the
General Fund, the sum of $21,547,547, which may be expended only
for debt service and administrative costs relating to debt
service on outstanding general obligation bonds sold pursuant to
Article XI-G of the Oregon Constitution. + }
  SECTION 6.  { + In addition to and not in lieu of any other
appropriation, there are appropriated to the Department of Higher
Education, for the biennium beginning July 1, 2001, out of the
General Fund, the following amounts, which may be expended only
for the following purposes:
  (1) For support of the Agricultural Experiment Station and the
branch experiment stations of Oregon State University,
$46,017,736.
  (2) For support of the Extension Service of Oregon State
University, $33,385,360.
  (3) For support of the Forest Research Laboratory of Oregon
State University, $3,927,645. + }
  SECTION 7.  { + Notwithstanding any other law, the following
amounts are established for the biennium beginning July 1, 2001,
as the maximum limits for payment of expenses from fees, moneys
or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received
by the Department of Higher Education, for the following
purposes:
  (1) For support of the Agricultural Experiment Station and the
branch experiment stations of Oregon State University,
$15,109,599.
  (2) For support of the Extension Service of Oregon State
University, $22,450,997.
  (3) For support of the Forest Research Laboratory of Oregon
State University, $8,918,046. + }
  SECTION 8.  { + Sections 6 and 7 of this 2001 Act do not
prohibit the Department of Higher Education or the State Board of
Higher Education from expending moneys in addition to the
appropriations and limitations made by sections 6 and 7 of this
2001 Act if such additional moneys are otherwise available as
provided by law for expenditure by the department or board for
gift, grant and contract activities and auxiliary enterprise
activities. + }
  SECTION 9.  { + Notwithstanding any other law, sections 1 to 4
and 6 to 8 of this 2001 Act are subject to Oregon Department of
Administrative Services rules related to allotting, controlling
and encumbering funds. + }
  SECTION 10.  { + This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2001 Act takes effect
July 1, 2001. + }
