Be It Enacted by the People of the State of Oregon:

Human Services, for the biennium beginning July 1, 2001, out of
the General Fund, the amount of $2,499,024,746 to be expended

SECTION 2. { + Notwithstanding any other law, the amount of
$7,145,478 is established for the biennium beginning July 1,
2001, as the maximum limit for the payment of expenses from
lottery moneys allocated from the Administrative Services
Economic Development Fund to Alcohol and Drug Abuse Programs for
gambling addiction treatment and prevention. + }
SECTION 3. { + Notwithstanding any other law, the amount of
$874,119,108 is established for the biennium beginning July 1,
2001, as the maximum limit for the payment of expenses from fees,
moneys or other revenues, including Miscellaneous Receipts,
tobacco tax receipts and Medicare receipts and federal funds for
indirect cost recovery, collected or received by the Department

SECTION 5. { + Notwithstanding any other law, the amount of
$124,000,000 is established for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from moneys
transferred to the Department of Human Services from the Tobacco
Settlement Funds Account established by section 1, chapter ___,
Oregon Laws 2001 (Enrolled House Bill 2450), for Medical
Assistance Programs. + }
SECTION 6. { + Sections 3 and 4 of this 2001 Act do not limit,
affect or apply to expenditures for Women, Infant and Children
Nutrition Program food vouchers, federal food stamp benefit
payments and Community Health Insurance Program reimbursable drug
purchases. + }
SECTION 7. { + This 2001 Act does not prohibit the Department
of Human Services from transferring funds and expenditure
limitations among programs identified in a single subsection of
section 1, 3 or 4 of this 2001 Act or, for Mental Health and
Developmental Disability Services programs identified in section
1 (2) and (3), 3 (2) and (3), 4 (2) and (3) or 6 of this 2001
Act. + }
SECTION 8. { + Notwithstanding ORS 411.010 and 413.029, the
funds appropriated by this 2001 Act may not be used to meet the
costs of burials, except for persons in the care and custody of
the Department of Human Services. + }
SECTION 9. { + (1) In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, for
the biennium beginning July 1, 2001, out of the General Fund, the
amount of $32,689,324 for allocation to the Department of Human
Services for the following purposes: + }

this section are not allocated by the Emergency Board for the

November 1, 2002, such unallocated moneys on that date become
available for any other purpose for which the Emergency Board may
lawfully allocate funds. + }
SECTION 10. { + Notwithstanding any other law, all sections of
this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling and encumbering
funds. + }
SECTION 11. { + This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2001 Act takes effect
July 1, 2001. + }
