  Appropriates moneys from General Fund to Department of Human
Services.
  Limits biennial expenditures from fees, lottery funds, moneys
or other revenues, including Miscellaneous Receipts, tobacco tax
receipts and certain federal receipts, collected or received by
Department of Human Services.
  Limits biennial expenses of Department of Human Services from
federal funds.
  Transfers certain moneys received by Department of Human
Services under Proportionate Share Incentive Adjustment State
Plan Amendment to State Medicaid Plan to General Fund.
  Declares emergency, effective July 1, 2001.
 
                        A BILL FOR AN ACT
Relating to state financial administration; appropriating money;
  limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:

Human Services, for the biennium beginning July 1, 2001, out of
the General Fund, the amount of $2,638,668,403 to be expended

2001, as the maximum limit for the payment of expenses from
lottery moneys allocated from the Administrative Services
Economic Development Fund to the Office of Alcohol and Drug Abuse
Programs for gambling addiction treatment and prevention. + }

  SECTION 5.  { + Sections 3 and 4 of this 2001 Act do not limit,
affect or apply to expenditures for Women, Infant and Children
Nutrition Program food vouchers, federal food stamp benefit
payments and Community Health Insurance Program reimbursable drug
purchases. + }
  SECTION 6.  { + This 2001 Act does not prohibit the Department
of Human Services from transferring funds and expenditure
limitations among divisions and programs identified in a single
subsection of section 1, 2, 3, 4 or 5 of this 2001 Act or, for
the Mental Health and Developmental Disability Services Division,
between divisions and programs identified in section 1 (2) and
(3), 3 (2) and (3), 4 (2) and (3) or 5 of this 2001 Act. + }
  SECTION 7.  { + Notwithstanding ORS 411.010 and 413.029, the
funds appropriated by this 2001 Act shall not be used to meet the
costs of burials, except for persons in the care and custody of
the Department of Human Services. + }
  SECTION 8.  { + (1) That portion of the payment received during
the 1999-2001 biennium by the Department of Human Services from
health districts in this state under the Proportionate Share
Incentive Adjustment State Plan Amendment to the State Medicaid
Plan and under intergovernmental agreements with the health
districts that is attributable to the federal funds portion of
the total payment made by the department to the health districts
during the 1999-2001 biennium shall be transferred to the General
Fund.
  (2) That portion of the payment received during the biennium
beginning July 1, 2001, by the Department of Human Services from
health districts in this state under the Proportionate Share
Incentive Adjustment State Plan Amendment to the State Medicaid
Plan and under intergovernmental agreements with the health
districts that is attributable to the federal funds portion of
the total payment made by the department to the health districts
during the biennium beginning July 1, 2001, shall be transferred
to the General Fund. + }
  SECTION 9.  { + Notwithstanding any other law, all sections of
this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling and encumbering
funds. + }
 
  SECTION 10.  { + This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2001 Act takes effect
July 1, 2001. + }
