Chapter 12 Oregon Laws 2003

 

AN ACT

 

SB 859

 

Relating to state finance; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Notwithstanding ORS 359.400 to 359.444, the amount of $3,338,538 is transferred from the Trust for Cultural Development Account established under ORS 359.405 to the General Fund.

 

          SECTION 2. Notwithstanding ORS 184.642, the amount of $7,371,543 is transferred from the Department of Transportation Operating Fund to the General Fund.

 

          SECTION 3. Notwithstanding ORS 458.620, 458.625 and 458.630, the amount of $15,500,000 is transferred from the Housing Development and Guarantee Account to the General Fund.

 

          SECTION 4. Notwithstanding ORS 657.783, the amount of $14,843,238 is transferred from the Supplemental Employment Department Administration Fund to the General Fund.

 

          SECTION 5. Notwithstanding ORS 461.547, from moneys that would otherwise be transferred to counties under ORS 461.547, the amount of $1,900,000 shall instead be transferred to the Administrative Services Economic Development Fund.

 

          SECTION 6. Notwithstanding ORS 431.832, the amount of $4,038,000 is transferred from the Tobacco Use Reduction Account to the General Fund to be available for general governmental purposes.

 

          SECTION 7. Notwithstanding ORS 459.775, the amount of $625,000 is transferred from the Waste Tire Recycling Account to the General Fund.

 

          SECTION 8. Allotment reductions adopted by the Oregon Department of Administrative Services on January 2, 2003, as temporary administrative rule 122-065-0030 shall remain in effect for the remainder of the biennium ending June 30, 2003.

 

          SECTION 9. (1) Sections 3, 4 and 5 of this 2003 Act become operative only if the economic and revenue forecast for the remainder of the biennium ending June 30, 2003, that is scheduled to be released by the Oregon Department of Administrative Services on May 15, 2003, is more than $150,000,000 below the forecast that was released on February 28, 2003. For purposes of this subsection, the amount of the forecast does not include any proceeds of bonds issued under chapter 11, Oregon Laws 2003 (Enrolled Senate Bill 856), and credited to the General Fund.

          (2) If the condition specified in subsection (1) of this section is met, sections 3, 4 and 5 of this 2003 Act become operative on June 1, 2003.

 

          SECTION 10. (1) Notwithstanding ORS 359.426 (1), the office of the Secretary of State may disburse a portion of the moneys in the Trust for Cultural Development Account during the 2002-2003 fiscal year regardless of the amount that was in the account on July 1, 2002.

          (2) Notwithstanding subsection (1) of this section and ORS 359.426 (1), for the time period between the effective date of this 2003 Act and July 1, 2004, the office of the Secretary of State may not disburse more than $693,000 from the Trust for Cultural Development Account.

 

          SECTION 11. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect on its passage.
