Relating to assignment of support payments; creating new provisions; and amending ORS 25.720.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. ORS 25.720 is amended to read:
25.720. (1) Except as provided in ORS 25.125, 418.032, 418.042, 419B.406 or 419C.597 or subsection (2) of this section, the right to receive child or spousal support payments under ORS chapters 107, 108, 109, 110, 416, 419B and 419C is not assignable, and any transaction in violation of this section is void.
(2) Notwithstanding the provisions of subsection (1) of this section, the right to receive support payments is assignable as may be appropriate for the protection of a minor or other person [under ORS chapters 125 and 128 and ORS 97.929, 97.937, 97.992 and 97.994] for whom a fiduciary has been appointed under ORS chapter 125 or for whom a trust has been established.
(3) [No person shall] A person may not solicit or accept the assignment of support rights under subsection (1) of this section.
SECTION 2. The amendments to ORS 25.720 by section 1 of this 2003 Act do not affect any assignment of the right to receive support payments made under ORS 25.720 (2001 Edition). Nothing in the amendments to ORS 25.720 by section 1 of this 2003 Act is intended to change the authority to assign the right to receive support payments under ORS 25.720 (2001 Edition).
