Relating to Board of Naturopathic Examiners; creating new provisions; and amending ORS 685.160.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. ORS 685.160 is amended to read:
685.160. (1) There hereby is created the Board of Naturopathic Examiners in the Department of Human Services. The board shall consist of [five] seven members appointed by the Governor for terms of three years commencing July 1, and until their successors are appointed and qualified. A majority of the members of the board constitutes a quorum. [The Governor shall fill all vacancies in the membership of the board.] If there is a vacancy for any cause, the Governor shall appoint a member to serve for the remainder of the unexpired term. All appointments of members of the board by the Governor are subject to confirmation by the Senate in the manner provided in ORS 171.562 and 171.565.
(2) Of the membership of the Board of Naturopathic Examiners:
(a) All members must be citizens of this state.
(b) [Four] Five members shall be naturopaths who have each practiced continuously in this state for the five years immediately prior to the date of appointment.
(c) [One] Two shall be [a member] members of the general public who [does] do not possess the qualifications set forth in paragraph (b) of this subsection.
(3) The board shall carry into effect the provisions of this chapter and is authorized to issue licenses to practice naturopathic medicine in this state. The possession of a common seal by the board hereby is authorized.
SECTION
2. (1) Notwithstanding the
amendments to ORS 685.160 by section 1 of this 2003 Act, the Board of
Naturopathic Examiners shall adopt by rule a method for establishing terms of
office for members of the board appointed on or after the effective date of
this 2003 Act so that the terms of office of no more than three members of the
board expire in the same year.
(2) Nothing in this 2003 Act affects the term of office of any member of the Board of Naturopathic Examiners appointed prior to and serving on the effective date of this 2003 Act. However, as vacancies occur, appointments shall be made in accordance with the requirements specified in this 2003 Act.
