Relating to civil penalties levied by State Department of Agriculture; amending section 7, chapter 390, Oregon Laws 1999.

Be It Enacted by the People of the State of Oregon:

SECTION 1. Section 7, chapter 390, Oregon Laws 1999, as amended by section 1, chapter 23, Oregon Laws 2001, is amended to read:

Sec. 7. (1) The State Department of Agriculture may not levy a civil penalty under section 2, 4 or 6, chapter 390, Oregon Laws 1999, for any violation occurring after December 31, [2003] 2005.

(2) Sections 2, 4 and 6, chapter 390, Oregon Laws 1999, are repealed December 31, [2004] 2006. The repeal of sections 2, 4 and 6, chapter 390, Oregon Laws 1999, does not relieve any person of the obligation to pay a civil penalty lawfully imposed by the department prior to December 31, [2004] 2006.
