Chapter 426 Oregon Laws 2003
AN ACT
HB 5064
Relating to state financial administration; creating new provisions; repealing section 1, chapter 978, Oregon Laws 2001; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. Notwithstanding any other law limiting expenditures of the Department of Education for the payment of expenses of the Oregon State Schools for the Deaf and for the Blind from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2003, the limitation on expenditures for the department established by section 2 (2), chapter 799, Oregon Laws 2001, is increased by $245,000.
SECTION 2. Notwithstanding any other law limiting expenditures of the Department of Education for the payment of expenses of the Youth Corrections Education program from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2003, the limitation on expenditures for the department established by section 2 (3), chapter 799, Oregon Laws 2001, is decreased by $500,000.
SECTION 3. Notwithstanding any other law limiting expenditures of the Department of Education for the payment of grants-in-aid and purchased services from federal funds received by the Department of Education from the United States Department of Agriculture for the biennium ending June 30, 2003, the limitation on expenditures for the Department of Education established by section 3 (2), chapter 772, Oregon Laws 2001, is increased by $16 million.
SECTION
4. (1) Notwithstanding any other
law, the amount of the transfer established by section 6, chapter 890, Oregon
Laws 2001, from the Medicaid Upper Payment Limit Account to the Department of
Education for the State School Fund for the fiscal year ending June 30, 2003,
is reduced by $7,480,856.
(2) Notwithstanding any other law limiting expenditures of the Department of Education for the payment of expenses from moneys allocated from the Medicaid Upper Payment Limit Account to the Department of Education for the State School Fund for the fiscal year ending June 30, 2003, the limitation on expenditures for the department established by section 8, chapter 890, Oregon Laws 2001, is decreased by $7,480,856.
SECTION 5. Notwithstanding any other law limiting expenditures of the Oregon Department of Administrative Services for the payment of expenses from moneys allocated from the Medicaid Upper Payment Limit Account to the Oregon Health and Science University public corporation, for the biennium ending June 30, 2003, the limitation on expenditures for the department established by section 2, chapter 800, Oregon Laws 2001, is decreased by $308,061.
SECTION 6. Notwithstanding any other law limiting expenditures of the Oregon Department of Administrative Services for the payment of expenses for the Oregon Rural Health Association from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2003, the limitation on expenditures for the department established by section 2, chapter 80, Oregon Laws 2001, as amended by section 2 (4), chapter 11, Oregon Laws 2002 (third special session), is reduced by $7.5 million.
SECTION 7. Section 1, chapter 978, Oregon Laws 2001, is repealed.
SECTION 8. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Human Services, for the biennium ending June 30, 2003, out of the General Fund, the amount of $45,560,309, for the purpose of supplementing the appropriation established in section 1 (3)(a), chapter 892, Oregon Laws 2001, for senior and disabled services.
SECTION 9. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect on its passage.
